As an employer, do I have the duty to remind my staff to use up all their paid holiday in a leave year?

yes you have a duty morally but prepared to take the flack if you don't ......not sure about legally but happy staff is good staff but most staff know their rights their not all stupid so.....do the right thing

in my department the manager prints off each employees leave report which shows what days you had off as leave in a list format. And at the top the amount to leave had from start of year and how many days remaining. I'm sure your employees should be aware of what leave they have left? in my place only 3,4 days max can be carried forward.
I think it would be a nice considerate thing to inform ur employees of this, as im sure you wouldnt like ur boss doing this to u? u know working hard all year etc

As an employer you have a moral obligation to your staff to post some kind of notice or memo. You should remind them of any rules or regulations that your company has about taking their paid time off and have a list available with each person and how many days they have to use by what ever date. When in doubt take the high road...that's how you keep great employees!

Not sure about the law but if you don't tell them and they find out you're in big trouble, people can do nasty things when you mess with their wages. take care.

YES!!! You not only have a duty to do so but a moral obligation to do so. If you " INTENTIONALLY or WILLFULLY"...(as described under the Employment Services Act) are proved to have not notified them, the employee can take you to task over it and any tribunal will slaughter you.

There is one loop hole in the Employment Law however which lets you off the hook.
If, when first employing the individual you have given them a "Terms of Contract", which states that it is EVERY EMPLOYEES DUTY, to keep track of their own annual paid holidays, and that it is NOT THE DUTY or LIABILITY of your company to inform them, then you are covered under the Terms of Contract. Make sure the Terms of Contract are signed and dated by the employee though as soon as you have employed them.

Why on earth would you NOT want to notify them is my question?

Yes. But the new term is now called colleagues. But whether you have the duty to do so depends on what kind of person you are, if you can't work that one out for yourself then i'm glad i don't work for you!

You do not have a 'Duty' to remind them but if it is not black and white in their contracts of employment then it would save you any furture problems if you did remind them
