I went for an interview for a job today and the guy asked me if I would consider being self-employed as I wouldn't have to pay as much NI, and he could pay me a bit more. He said his accountant could sort it out for me and I'd just have to write a cheque every year for my tax.
I said I would consider it.. but it this a good idea or would I be losing out? |

yea i did this for 10 years, it has its pros & cons.......
good things- you`ll have more money because you`ll pay far less in tax & national insurance ( a lot less by the way )....
bad things- no holliday pay or sick pay but what i did was with the money i was saving id put say £25 a week away to cover my holliday pay & took a £15 a month insurance policy out to cover if i was off sick.
it isnt a bad thing.. my employer did pay me holliday pay and after a few years he gave my a £100 a week pay rise but sead he`d stopp the holliday pay... id give it a try & see how it works out ! |

Be very careful, this is not an easy question to answer without knowing the specifics of your job and the company. A few years ago many people were paying less tax by declaring themselves "self-employed" but were actually only working for 1 company. The tax office produced "IR56" which tightens and explains who should be employed and self-employed for tax purposes.
Please read this page from HM Customs and Revenue very carefully: http://www.hmrc.gov.uk/pdfs/ir56.htm
"You or the person you work for, cannot simply choose whether you will be an employee or self-employed. It will depend on the terms, conditions and facts of your engagement."
Many people in the computer industry become self-employed contractors because they can claim things against tax. For example my "office" would be my house so I can claim tax relief for a percentage of my mortgage.
But as you are the "employer", how do you pay yourself for holidays and time off sick? |

He won't have to pay your NI, or sick pay, or parental leave, or insurance, or expenses, or redundancy, or holidays. In short you will have no rights and he can let you go with no notice and for no reason.
What he is doing is unlawful - he can't just decide to make you self employed. If you are working for him, at his premises, cannot send anyone to do the job, cannot choose your own hours or rate of pay, cannot make a loss, then you are not self employed.
This is a shoddy way to treat people. |

You can't really pick whether you are self-employed. Even if you say you are it is likley in your case that the Revenue will say you are employed and tax you / charge NI accordingly.
There is a kind of quiz/calculator on HMRC's website which can determine your status.
However if that isn't an issue being self-employed will be marginally better as lower national insurance for you (but about 3%) and for your employer (by 12.8%!) and as you can deduct certain expenses from your earnings.
The downside is filling in a tax return can be a bit of an administrative challenge. It's not hard but you do need to keep decent records and be resigned to complete it in time. You also would need to make payments on account on your tax twice a year. |

You might be doing yourself out of sick pay and holiday pay, and also any rights that an employee would have.
On the other hand, it can work quite well, although legislation is constantly changing. |
