Hi I work for housing benefits and have done for 10 years, if you have been overpaid tax credits its highly unlikely that your housing benefitis have been overpaid, if anything it would have been underpaid. Ask your local council for a written explanation of how they arrived at the overpayment, ask them for the income they had for you before and after the overpayment occured, and what the cause of the overpayment was, there are appeal channels and tribunal channels that you can follow if the council are in the wrong with this overpayment. Get all the information I have suggested and if you still don't understand why you have an overpayment feel free to email me. |

Yes. Get your bottom down the council, and ask to see proof as to HOW EXACTLY you owe that money. There is a law that requires them to show you their proof, else you don't have to pay. If there's no proof, don't pay. |

Have you been to the CAB for advice?? you can even get the first half hour free with a Solicitor for advice.
If you get overpaid in the working tax credit you do have to pay it back even though it is their fault.
I am not sure if the same applies to housing benefit.
If you gave the housing benefit people correct information and they worked it out wrong you may have a case.
You would find out at the CAB !!!! |

I would try and get some help with this. You could try the Citizen's advice Bureau although I have found them to be utterly useless, that's if you can find one open ! A better bet is to ask someone like the Daily Mail's financial help. They do get things done. Presumably you are not ethnic or you would not be in this position. |

I suggest that you request someone to come and re-evaluate what you are entitled to.
Tell them you want to be 100% sure that they have it correct because you are not going to be giving them one penny back if they over pay you again.
To be honest - i'd be tempted to tell them they can take you to court for the money back because you trusted their judgement and spent it as you recieved it and you do not think you should have to pay for their error as it is causing you a great deal of distress. |

I went on incapacity benefit when my sick pay ran out from work whilst i was having treatment for breast cancer. When i returned to work they changed my tax code and i have been paying a higher rate of tax for a year, they also said we were paid £2,000 to much in child tax credits which i am still paying back now, so you are not alone but there is nothing you can do about it . They don't care if you are starving or you can't pay your bills as long as they get there money back. |

I think you should collect up your paperwork and go to the Citizens Advice Bureau - don't try phoning them they don't have time to answer, they should be able to help you to get it all sorted out.
We are currently fighting a similar thing ( they claim they miscalculated for 4 years and want £3000 off us) |

First ask them for proof of the overpayments in writing.
Get down to the Council and ask how THEY got it wrong when you gave them correct information.
Get an appointment with the Citizens Advice Bureau, they will do a benefits check and tell you what you are entitled to claim. Then put in fresh claims. Go to this site:-

New rates for tax credits started on 6th April.
Don't pay one penny back until you have proof that this was an overpayment. They get these things wrong all the time but you'll not get your money back if this is the proven. Get legal aid advice.

Don't let it go to court. If it turns out they're right you'll have to pay expenses on top of this amount. If you get an explanation from them make sure you get it in writing, not the phone.
You are probably entitled to free legal help with this, phone round a few solicitors and ask. Sometimes a snotty letter from one works wonders. Best of luck. |

Not sure if you will get any joy from them. My best mate has been on various benefits on and off and it seems that one department has no clue what the other one is up to. She has had refunds but also had to pay back monies which the government reckoned she wasn't entitled to. I agree that if the government have made a pig's ear of things, they should not expect you to pay for their mistake. Perhaps you could have a wee word with Citizen's Advice folk. They are very good at ploughing through the minefields in the system. Good luck. |

everyone is helping them self's to benefits which I have to contribute towards every god dam payday.
I pay over £1000 tax each month your obviously not mentally retarded so whats stopping you getting a job.
And why should you not pay it back maybe I should be asking why do I have to pay for the likes of you????
Get a job and you will know how I feel if you ask me this country is too soft and should make you earn the pittance you get so it encourages you to get off your behind and do something.
There are plenty of disabled people who have good jobs who have worked hard for them and would probably be more annoyed than me if they read this you make me sick |
