I agree, the best thing to do is to set up a payment plan, but..
If it is a VERY, VERY large amount of taxes, you may be able to do what is called an offer of compromise with the IRS. It is an agreement that you may end up paying only a percentage of what you owe them. This is a complicated procedure but not impossible. I would contact a professional CPA to handle this for you. |

The IRS just wants the money and you probably can work out a payments plan to get your caught up. Call the IRS tell them your problem and ask for the office that can give you some help. This will take more than one phone call. |

Start off by calling IRS at the phone number provided in the balance due notice. Then offer a payment proposal for an installment agreement. IRS charges a one time USER FEE of $105.00 for installment agreement in which you mail in your payment or $52.00 if you have them take it out of your checking account, if at anytime during the installment agreement you default, revise or reinstate IRS will charge you $45.00. Any refund that are due to you will be applied to your balance due, and you still need to make you monthly payment amount. IRS usually lets you have 60 months to pay off your balance, so divide the amount you owe by 60 and that is your monthly payment, for balance of $1,500 or less IRS will accept $25.00 no less. By agreeing to an installment agreement you also agree to pay any new balance in full, such as if you file 2007 and you owe you will be asked to full pay the amount if you can't then they might allow you to added it to your installment agreement and raise the payment amount.

1. Stop the bleeding. If you are not having enought tax withheld, change your W-4 so that the correct amount is being paid in.
2. If you owe less than $25,000 and can pay in full over five years (thats about $22 per month per $1,000) IRS will set you up on an installment agreement without much fuss.
3. If you can pay but need more than five years, you will have to complete a pile of aggrivating paperwork to prove it.
4. If you can't pay AND IRS agrees, you will have to complete a pile of aggrivating paperwork to prove it and the account can be reported currently not collectible and will stay on the back burner until your situation improves. If the balance due is over $5,000, IRS will file a Notice of Federal Tax Lien in your county. This will cause your credit rating to take a major nosedive.
4. If you are unable to pay but can make a lump sum payment that is equal to what IRS considers the "reasonable collection potential of the account" you can submit an offer in compromise through which you would pay less than 100 cents on the dollar. I put these together as an enrolled agent licensed by the Treasury Department to represent taxpayers the same as attorneys and CPAs. If you want more information about the process you can email me through my profile. Whatever you do don't go to any of the tax resolution companies that advertise on cable TV. Their fees are out of this world and many of them have bad records with the local Better Business Bureau. An enrolled agent with a collection background is best but other enrolled agents and CPAs can help. |
