No, you can't claim him if he doesn't live with you and you don't support him. Otherwise don't you think everyone would try that. As far as you tax return would be one and that's you. You could also get in trouble for trying to claim him, especially when some one else does who is supporting him, be a Mother or Father Or Grandparent, someone who is a Guardian. |

Maybe. If you provide more than half of his support and no one else claims him on their taxes. You can list single with a dependent and click the box other for relationship.
Call the IRS to be sure. Or, if you use Turbo Tax or other software it will tell you. |

He doesn't live with you? Then probably not. You MIGHT be able to claim him, as a qualifying relative only, just a $3500 exemption, no credits, no head of household, if you can prove that you provided over half of his support and he isn't anyone else's qualifying child - but that's pretty unlikely since he is almost surely someone's qualifying child - who DOES he live with? And why do you feel you should be able to claim him? With more info by answers to those questions, would be easier to give you an answer. |

If he didn't live with you you MIGHT be able to claim him under the Qualifying Relative rule if the following tests are met:
1. Nobody else can claim him as a Qualifying Child.
2. He has less than $3,500 in gross income.
3. You provided more than half of his support for the entire year.
If you qualify under the above rules you get the exemption only. Ho Head of Household status. No Child Tax Credit. No EIC. No Child & Dependent Care Credit. |

If your baby nephew lived more than half the year (or his life if a newborn) with his parents, grandparents, or different aunt or uncle, then he is their qualifying child and he cannot be your dependent.
If your baby nephew is not anyone's qualifying child and you provided more that 50% of his support and his income was not more than $3500, then you can claim him as your dependent even if he did not lives with you. You would file single with one dependent in this case.

You would not get eic or child tax credit since he is not your son. You could only get a reduction in your taxable income. Since he does not live with you and you do not provide over half of his support, no you could not claim him |

The only person allowed to claim your nephew as a dependant is one of his parents, or if this is the case, a guardian. Your status would be single. |
