 The difference in claiming 1 or 0 on a W4..?
I am 21 and single.. so what is the best choice? I never know about how to fil these things out.....

Can I File Head of Household?
I live with my girlfriend, her son, and her mother in her mother's house. We have lived there for a little more than a year and have been paying half of the bills for maintaining the house. I am supporting my girlfriend and her child. I pay for everything for her and the baby: groceries, diapers, toilettries, etc.. Her mother does not buy anything for the house except what she uses/needs: no groceries, no laundry detergent, only her feminine products. She says she is going to claim Head of Household, can she? I am claiming the child as a dependent and my girlfriend is filing on her own, so her mother has no dependents she can claim, which would cancel her ability to claim HOH correct? And also, if she does claim HOH where does that leave me, am I still able to file HOH?

You do not have to have a qualifying child to file Head of Household, just a qualifying person, who YOU supplied more than 1/2 of maintaining the home, which includes mortgage, insurance, taxes and maintenance. If you supplied more than half of these expenses, then you should be able to file as HOH, but if you payed 1/2 of the utilities, groceries and everyday household needs only, that would not qualify you as HOH. The person who pays the mortgage, the insurance and the property taxes is the qualified HOH, and for you living in her home helps her qualify as HOH. You don't have to claim a dependant to file HOH, just a qualifying person living with you that you maintained the home for. So unless you also payed more than 1/2 of the mortgage, insurance and property taxes, the owner is the HOH. That leaves you filing as single. Only one person per household can file as HOH.

If her mother doesn't have any dependents, then no, she can't file as head of household.

You say "her son" about the baby referring to your girlfriend. If he is not YOUR biological child, then you can't file as head of household either. You don't just need any dependent to do that, you need a closely related one by blood, and if the baby is your girlfriend's son and not yours, then if she is filing you can't even claim the baby as a dependent, and whether she files or not, can't claim head of household. The other catch is that it's her MOTHER's house - since her mom is providing the house, that's a major contribution to the household expenses and would keep you from filing as head of household even if the baby was your biological child since the value of providing the house would almost certainly be more than the other expenses that you are providing.

The question is: Are you supporting anyone? That means you provide over 50% of their living expenses. To qualify for head of household status, you must pay more than half of the cost of keeping up a home for the year. You can determine whether you paid more than half of the cost of keeping up a home by using the following worksheet.

If the total amount you paid is more than the amount others paid, you meet the requirement of paying more than half the cost of keeping up the home.
Include in the cost of upkeep expenses such as rent, mortgage interest, real estate taxes, insurance on the home, repairs, utilities, and food eaten in the home.
If you used payments you received under Temporary Assistance for Needy Families (TANF) or other public assistance programs to pay part of the cost of keeping up your home, you cannot count them as money you paid. However, you must include them in the total cost of keeping up your home to figure if you paid over half the cost.
Costs you do not include. Do not include in the cost of upkeep expenses such as clothing, education, medical treatment, vacations, life insurance, or transportation. Also, do not include the rental value of a home you own or the value of your services or those of a member of your household.

There's also the questions: are the persons you are claiming your qualifying relatives? That means your girlfriend cannot be the qualifying child of any other taxpayer.
Does the dependent you are claiming have less than 3400 in earned income?
Does the dependent have a social security number?
The qualifying relative must have lived with you the entire year.

If your girlfriend had income she needs to claim her child. If the mother claims the child illegally you can still claim the child and both returns will be audited.

you should be paying more than 50% of your girlfriends expenses to claim head of household status. Also that other person should not be claimed as a dependent on another persons return - in this case her mother.

Only one person per address can claim HOH with a qualifying dependent. The question is does the mother have a qualifying child? But you can only claim HOH if you pay more than 50% of household expenses. Mortgage or rent is the largest expense I'm guessing the mother pays that plus the insurance and property taxes. Then the question to ask yourself is could you prove that you pay more than half in the event of an audit.
