Can someone claim her? Yes.
Can YOU claim her? I don't know. If the both you and the mother have that child for the same number of nights (you need records to show who had her the most), then the one of you who had the highest AGI could get to claim her. Keep good records as the IRS will want to see them.
However, you don't indicate whether you are a dependent or not--and dependents can't claim dependents of their own. |

Any child born during the year can be claimed on a tax return. You have to have a social security number for the child if you want to electronically file your return. This goes for children born before 11:59 pm on January 1st at well, as the IRS considers you born the day before your birthday for most things.
Either one of you may claim the child since you are both the parents. You just have to decide between the two of you which one is going to claim her. The IRS does not get involved unless two people claim the same person. It is then that the IRS tiebreaker rules come into play.
What you claim at work is not connected to your tax return except that what you claim at work governs how much taxes are withheld.

Which of you did she spend the MOST amount of time with in 2008? THAT is the person who is the custodial parent under the Tax Code and the one who may claim her.
This assumes that neither you nor the mother are dependents yourselves. Dependents cannot claim dependents. |

Whoever has her more than 50% and supports her over 50% has the right to claim her. You might consider taking turns each year. Some people split the deduction. |

You can claim her if you have full physical custody of her. If not you must work an arrangement out with her mother. Most parents trade years (ie mom claims child in odd years and father in even years). Work this out before you both file or both refunds will be significantly delayed while the IRS determines who has legal rights to claim her.
Any child born in 2008 can be claimed on 2008 taxes, even if the child was born at 11:59pm on 12/31. |
