Marcy Torres | Can I claim exemption on my W-4? |
So I have my first job ever and I have to fill out a W-4 form, and I got stuck on step 7 which says:
"I claim exemption from withholding for 2010 and I certify that I meet both of the following conditions for exemption:
- Last year I had a right to a refund of all federal income tax withheld because I had no tax liability and
- This year I expect a refund of all federal income tax withheld because I expect to have no tax liability"
and then it says that if i meet both conditions to write the word exempt in the box.
Do I write exempt? Additional Details Mind you I'm only getting minimum wage, on 4 hr shifts, only three days a week, and its only till i start school again. |

Claiming Single (any number between 3 and 8) will do the same thing of ensuring no Federal Income taxes withheld. Then no need to worry about "exempt" rules. Your claiming is only to guide payroll as to what rate and amount to withhold tax. It is not binding so no legal consequences for not listing your real self on the form (S-1).
By your additional details, probably no tax w/h even if you said S-0 |

On the W-4 there are the instruction and a worksheet. These worksheet are fairly accurate, You did not tell us what is your filing status, your job, the source(s) of your income(s) and if any of these incomes are non-taxable. |

as a student and dependent on your parents' return if you do not expect to make $5700 for the year 2010, you can file exempt |
|

Yes, you can. |

If you reasonably expect to make less than $5,700 this year (and it sounds like you can), then you can claim exempt on your W4. |
