It depends. Do you live with your spouse?
If yes, then you can't, and must file either married filing jointly or married filing separately. Though, you'll probably be better off filing jointly.
If you live apart from your spouse for the last 6 months of the year, paid 1/2 the cost of keeping up your home, can claim an exemption for your children, the children spent 6+ months of the year with you, and plan to file separately from your spouse, you may claim HOH. |

Head of household is the individual in the household who makes the most money, has the greatest income. My guess would be if your spouse is on disability, then yes you would be head of household. |

You could but you don't want to. Head of Household is for an unmarried, legally seperated people or people who have children but wish to file separate. You would benifit more if you file Married Filing Joint than to file separate because you get that extra exemption for spouce and higher standard deduction. Head of Household only gets 7300 standard deduction. Married filing joint is 10,000. If you file Head of Household then you only get 3 exemptions of 3200 a piece. If you file MFJ, then you get 4 exemptions at 3200 a piece. If your spouce recieved SSI, it does not count towards his income. If it is third party sick pay from his job, then it is taxable and you should receive paperwork to put this on your taxes. |

Yes of course you can....and you can also claim your spouse who is on the disability!....i did my taxes like that this past year....go to H&R block it will tell you there also.... |

yes you can you are the only able body that can work outside of the home. You are the head of the household by law.I don;t think that things have change so much for you not to file your family as your dependants. Oh yeah don't foreget that you can also claim the disable body too! |

No you can not. You can only claim head of household as long as you are not married or separated from your spouse for 6 months or more. Plus you get a larger standard deduction if you claim married filing jointly.
