Can I claim my 18yr old full time student on my taxes?
I have a 12yr old and an 18 yr old and I am wondering if I can claim the oldest one on my taxes this year? If so, will I still receive my stimulus check? My ex husband will not be claiming either one-so will I still recieve a stimulus check on one of them??

Ack! Zachary A's answer is completely WRONG. Please do not pay attention to it.

If you're talking about the NEW stimulus package, it has yet to be approved by congress, so we don't have any answers about that for sure. If you're talking about LAST YEAR'S stimulus package, then if you didn't receive a payment last year, or if you didn't receive the full amount last year, the IRS will examine your situation for your 2008 return and see if you qualify for additional money.

It appears from what you've said that you can claim both your children. You can claim your 18-year-old son on your taxes if you can pass these tests:

* The child must be your son, daughter, stepchild, foster child, brother, sister, half brother, half sister, stepbrother, stepsister, or a descendant of any of them.

* The child must be (a) under age 19 at the end of the year, (b) under age 24 at the end of the year and a full-time student, or (c) any age if permanently and totally disabled.

* The child must have lived with you for more than half of the year.

* The child must not have provided more than half of his or her own support for the year.

You can claim both of them if your ex isn't going to. The rules on your oldest change when he turns 19, though, so be aware of that.

If you already received your stimulus payment last year for you and both children, then you won't be receiving anything else. If, however, you did not, then, yes, it will be calculated based on your income and exemptions this year, so you'll get it.

There's only one payment, though, so if you already got it, don't expect another.

you can claim full time students until they are 23 or maybe older - there is NO stimulus check at this moment projected for this year and he would be too old to count I think - you would get the $3500 exemption and that's about it

You can claim them both unless your ex can, but will only get a child tax credit for the younger child, that only goes up to age 16.

Did you not get a stimulus check last year? Or if you were married then and filed a joint return, get a joint stimulus check for that? If you didn't, you might qualify this year for yourself, and for the 12 year old - you don't get extra for an 18 year old. And if you got it last year, there isn't another one.

As far as I know: yes. I'm 23 years old and this is the first year I can claim myself as an independent on my taxes because my parents claimed me as a dependent all 4 years that I was in college.
I don't know about the stimulus check though.

IRS Publication 501 has all the rules for exemptions.

The stimulus checks were sent out in 2008 based on 2007 taxes. If you are entitled to any more, that will be determined when you properly fill out 2008 tax forms. See http://www.irs.gov/newsroom/article/0,,id=186065,00.html
