Can I claim my boyfriends two kids since I live with them?
I worked 6 months in the begginning of the year and helped to pay for their rent, food, and clothing? I am not working now but i am not sure if that will make a difference. My boyfriend cant claim them because he is a disabled vetern, and if i can claim them how would i file, ex: Head of house etc.

Ok he does have 100 percent disability and does get disability and ss. The kids are his, the mom is no where in their lives. If he can claim that would be better we just assumed he couldn't.

I don't really understand why you think he can't claim them because he's a disabled veteran. If he is their father, he should claim them on his tax return as dependents. It doesn't matter if he didn't earn ANYTHING. He can still receive the child tax credit and get a refund.

If you're wanting to claim them as "head of household", you have to meet the requirements in Tax Topic 353: "What is Your Filing Status?" It states:

"Generally, to qualify for head of household status, you must be unmarried and you must have paid more than half the cost of maintaining as your home a household that was the main home for a qualifying person for more than half the year."

A "qualifying person" is a child for whom you can (and do) legally claim an exemption on your tax return.

If you meet this test, you CAN claim the kids as "head of household," but then your boyfriend cannot. The kids can only be claimed as a dependent on one person's tax return.

EDIT: I am amazed at all the WRONG answers that appear above. I wouldn't trust any answer that doesn't cite their source of information specifically.

You cannot claim these children this year. They didn't live with you the entire year.

You cannot claim these children even if they did live with you all year unless you can prove that you paid more than half of their support AND that no one else can claim them as qualifying children. (Even when you can claim them, it is as a qualifying relative only; since no EIC, no child tax credit; since they are not related to you by blood or marriage, they would never qualify you for HOH.)

The only way they aren't qualfying children to the father is if he makes less than $3400 in taxable income, doesn't have a filing requirement AND you pay for more than 1/2 of his support. Because if you can claim him as a dependent, then he can't have any dependents of his own.

Doesn't sound like you can claim them. You say you worked half of the year, and helped pay for their expenses. To claim them you'd have had to provide OVER HALF of their total support for the year - and anything their dad provided from his disability benefits would count as part of their support also - so it's probably very unlikely that you actually provided OVER HALF of their total support for the year, and if you didn't, you definitely can't claim them. There are additional rules you'd have to meet also, but you probably already can't just based on support.

The fact that maybe nobody else is claiming them doesn't matter. If YOU don't qualify to claim them, and it appears that you don't, then you can't claim them even if nobody else does either.

VB's answer is 100% correct. You cannot claim the children as dependents in 2007, and you cannot get the EIC or file as HOH.

What about their Mother? Does she claim? Get familiar with the divorce decree. Recommend you look at the requirements for dependents. As they are not yours, and you have no legal ties, it may be sticky.

Look at www.IRS.GOV and be patient. It only looks hard.

Also, look at TurboTax for your PC. This will be a very wise investment. If should guide you through making your return, and can file electronically for you.

Dang, I gotta get a girlfriend that moves in, takes care of everything and pays for support of MY kids. You got a sister?

if you were the PRIMARY financial supporter in the house for MOST of the year, you can file head of household, and you can claim them, but he cannot claim them. Only one person can claim the children.

i suggest you work the taxes out different way, with him head of household, and with you head of household and see which comes out to be more beneficial

see a tax specialist or attorney. in the phone booke are attorneys that give free consultations - make an appt with one or two of them and ask - heck the price is right and you'll have piece of mind. .
