Can I claim my child on this year's tax returns?
I lived with my child for 4 moths this year, was separated in April from wife and divorced in September. I have paid all child support due every week and am not behind. I'm filing out tax returns and I'm a little confused. Can we both claim our child or does only one claim her? Which one gets to claim if we both cannot?

No, you can't both claim your child. Usually you can agree who gets the deduction - IRS doesn't care. Perhaps you do one year and she does the next. If not, then she did not live with you more than 50% of the year, so the ex would get the deduction.

Paying child support doesnt matter. You cant claim that. I would say that her mother would claim her since she has spend over 50 percent of the time in her care. I know it sucks that you help support and can't claim her but I think it would really be the mom who claims

Only one person can claim your child. This is normally decided in the divorce decree, if not the deciding factor is usually who the child spent more time with over the year.

Did your child live with the mother the remaining 8 months? Whoever she lived with for more than 50% of the year and the parent that paid for more than 50% of her support during the year would legally claim the child as a dependent. Since you only had your child 4 months, it isn't likely going to be you. Speak with your ex spouse about it.. make sure both of you don't claim your child on each return because an audit will be sent and then the tax return for each of you will be delayed. Best Wishes!

If the mother has custody of the child and the child lives with her she has the right to claim the child. If she chooses not to claim the child, then you can claim the child with her permission. Do a comparrison on who would get the better benifit. Then talk it over and work out a plan.

The person who gets to claim her had for for 6 months plus. EIC rules.
Just because you pay child support does not automatically make you elligible to get her on taxes.
What do your divorce papers say? Usually, you can switch back and forth, she is going to get the EIC simply because the daughter lived with mom.
The standard deduction is the one that is generally rotated.
