Can I claim my deceased son on my taxes?
My wife and I lost our son due to a placental abrupt-ion last august. She was 33 weeks pregnant. My son was delivered through emergency c-section but only manged to sustain a heartbeat for 30 minutes. He was never given a social security number but I was given a death certificate. The issue is that was told I could claim him for the whole year as long as he was born before Dec 31. So since the beginning of last year, I've been claiming him as a dependent. Does this mean I will owe money, or can I still claim him? Thanks for any input.

i dont think you can claim him since you didnt give him a SS#

As long as your son was born live during 2008 as evidenced by a birth certificate you may claim him. Even if he only lived for a moment you may still claim the exemption for him.

If you did not get an SSN for him, attach a copy of his birth certificate to your tax return and write "Died" where his SSN would normally go.

If the child was born alive even for a moment, you can claim the child. Birth certificate must show that.

So sorry for your loss.

Since he was born alive, even though he didn't live long, yes you can claim him as a dependent for the year. Under those circumstances you don't need a ss# since none would have been issued. Write "deceased" in the space for ss#. Mail in your return, attaching a copy of the birth and death certificates.

So sorry for your loss. If he was born & passed in Aug. of 2008, yes, I'm pretty sure you will be able to claim him on this year's (2008) return.

As for the the SSN, I do believe the death certificate would be sufficient, but, I agree, call a tax preparation service & they should be able to answer your questions.

I'm so sorry for your loss :( I don't know if you can claim him though. I would just call H and R Block and ask to speak to an advisor. They are usually pretty helpful.
