One of her friends that does taxes on the side said I could claim them as EIC since they lived with me and I supported them all last year.I think she made about $2000 for last year if even that much.I already filed my taxes and all but thenher friend said she'd do a amended return for me...for just $100 bucks.... and I'd get some more back. Is this true? My job ...I work for plastech (look it up if you haven't heard already) and will be closing down in the next few weeks and a little extra would come in real handy!!!! Sure, you can claim non-relatives as dependents if they live with you and you can prove that you are the sole provider. If they have a daddy who pays child support then you have a can of worms on your hands.
Your best bet is to get a tax preparer to talk to you. |

You can probably claim them as dependents under the Qualifying Relative rule, however you may NOT claim the EIC as they are not YOUR children. Even though the mother didn't earn enough to be required to file a tax return, she still can file and claim the EIC herself. With only $2,000 in earned income it won't be a lot, but it's better than nothing.
This "friend" of hers who is offering to do the amended return sounds incompetent to prepare tax returns. She may know the mechanics but doesn't know the law; the EIC rules are basic "Tax 101" issues. She either doesn't know the basics or is being dishonest in an attempt to grab $100 from you. Either way, don't trust this clown with your taxes! |

You cannot claim the children as your "qualifying children" since you are not related to them. This means that you cannot get the Child Tax Credit or Earned Income Credit even if you lived with them and supported them.
However, given your information, it appears you could have claimed the children plus their mother (if she earned $3,400 or less in 2007). If so, amend your return if it results in a refund.
I recommend you go to a tax preparer who knows the rules and not be tempted to pay $100 for an incorrect return. |

You may be able to claim them as dependents but they do not qualify you for Head of Household, Child Tax Credit, or the Earned Income Tax Credit.

No, they are NOT your children so you can't claim them for EIC - her friend shouldn't be doing taxes if she messes up on something that simple, she will get her clients into a lot of trouble.
It 's very possible you can claim them as dependents though - check "other" when it asks for relationship. You can't legally get EIC, head of household, or a child tax credit for them though. |

No, you they are not qualified kids for EIC as you do not meet the relationship test.
They can be your dependents (under Qualifying Relative) if they lived with you for the year and you provided more than half of their support.

Okay, now you understand that these children can probably be claimed as "qualifying relatives" on your tax return. Even without all the extras, just having 3 more dependents on your tax return can be to your advantage.
$10,200 more in exemptions. This reduces your income by $10,200. If you had this much in taxable income before, this is worth $1000+ in less tax.
No matter who does your amended return, look at it before you send it in.
Page 1. The first change you would see is line 4.
Eg, Line 4:$3400, $10,200, $13,600.
You should *only* see changes on line 4, 5, 6, 8 and 10.
If you see changes to lines 2, 7, 13 and 14, your preparer did it wrong.
On page 2, the line 28 would show 0,3,3. You would see nothing on line 26 or 27.
On line 33, you would see "none" or "other" under relationship. You would NOT see "nephew" "neice" "stepchild" or "foster child."
Every valid post on this thread is trying to do you a HUGE favor. I have talked to too many taxpayers who didn't think it would hurt to claim their girlfriend's kids as a stepchild. (After all, they are planning to marry her eventually.) The problem is, legally the child wasn't for the tax year and the IRS *will* audit them. Even if the IRS doesn't catch on at first, they do eventually and it's very painful to pay back $3000 with penalties, interest and a flag the prevents you from claiming any children for EIC for the next ten years....all because their stupid friend told them they could do it. |

that depends....my husbands union took care of my (his) step child till 16 and then they played a new law my son wasn't allowed health benefits all of a sudden took care of my child since 8 months old...lo and behold he fell of a bike broke his back and foot now we are in debt from something he paid 4 dollars an hour out of his pay check that was never used . now its needed and we owe cuz some new law...BS never paying it. Never will . Was charged for the tissues we used... my husband has BS/.BS who changed this law...certainly not me |

The children are NOT your qualifying relatives, because they are qualifying children of another taxpayer, your GF. It doesn't matter if she files a return or not. Your GF is your qualifying relative, however. |

Yes as long as they lived with you for more than 6 months of the year and you have their ss numbers. Make sure father dosen't claim them then your all good. |
