of course.

You don't claim a husband, you file jointly. If the child was born in Dec, it counts as having been alive all year for tax purposes. If your husband doesn't work, you still have to file a joint return or file married filing seperately. DO NOT file as both single, or single/head of household, this would be fraud and can get you in lots of trouble. See a professional if you have no idea what you are doing.

Yes, you are married and you had your son as of Dec 31, 2007. So you can file jointly with him or married filing separately. If you file separately only one of you can claim your son. But it would just be easier doing them jointly. Congratz on the marriage and the new baby!

Gary
Yes you can. The key date is Dec 31, 2007. (1) What is your martial status? and (2) How many children do you want to claim?

You can't claim a spouse as a dependent, but you can file a joint return with him whether he had any income or not. You can claim your son as a dependent.

You can file a joint return with your husband and claim your son as the third exemption and get a $1,000 child credit for him. You will need to apply for a social security number for your son as soon as possible.

You can never claim a spouse, period. If you file a joint return, your husband will be on that return and will be counted as another exemption. If you file a seperate return, then you obviously cannot put your husband on your return. But if you file as Single or Head of Household, then you filing your taxes incorrectly.

Since your son was born before the end of 2007, you and your husband will be able to claim him on your next tax return. Even though he was only around for a month, you can still claim him. Even though you were married for part of the year, you two file as if you have been married all year.

stephenweinstein
You can claim your husband only if you file jointly, but not if you file separately.

You can probably claim your son in either case, provided the support, etc., tests are met and that his father is not entitled to claim him.

A baby born at 11:59 PM on Dec 31, 2007 can be claimed as a deduction for the whole year of 2007. So your baby is counts. I think you would have to prove that you provide for at least 50% of your husbands support to claim him as a deduction. You can find that in the 1040 instructions or on the IRS site. Be sure before you file.

GG
as dar as i know, as long as its at least half the year you can
