Can I claim my minor son if he is filing taxes?

Charles G
Does minor mean under 18? If he is under 19 and does not support himself at least 50%, you can and should claim him as a dependent (assuming he lives with you).

He will need to prepare his taxes but not claim his personal exemption.

Many minors work and make income. This isn't that unusual.

If you provided over half of his total support, absolutely. He would still file his tax return, but fill out his return, checking the box that says that someone else can claim him as a dependent.

(If he lives with you, and you pay mortgage/rent, utilities, food...you definitely support him)

Yes, if he meets the qualifications as your dependent, it does not matter if he is filing taxes or not.

If he does meet the qualifications to be your dependent, he needs to make sure that he does not claim his own exemption when he files.

If you support your son and he lives with you - Yes.

Your son can file taxes. On the return it will ask if he is eligible to be claimed by someone else. If the first is true, he must say yes. If he only makes a few thousand dollars a year, he'll get all his withholding back even if you claim him.

Jay
Yes, if he lived with you for more than 6 months of the year. His form will ask if he can be claimed as a dependent. He will have to answer yes to this.

Yes, of course you can. When he files his tax return, he just needs to make sure he enters "yes" in the box where it asks if he's being claimed as a dependent by anyone else. He won't get to claim the exemption for himself, but if his income is minimal, he'll still wind up getting back everything that's been withheld from his check.
