You cannot claim a person as a dependent unless that person is a U.S. citizen, U.S. resident alien, U.S. national, or a
resident of Canada or Mexico, for some part of the year.
An ITIN, or Individual Taxpayer Identification Number, is a tax processing number only available for certain nonresident and resident aliens, their spouses, and dependents who cannot get a Social Security Number (SSN). It is a 9-digit number, beginning with the number "9", formatted like an SSN (NNN-NN-NNNN).
To obtain an ITIN, you must complete IRS Form W-7, IRS Application for Individual Taxpayer Identification Number (PDF) . The Form W-7 requires documentation substantiating foreign/alien status and true identity for each individual. |

If our laws were enforced here, and scummy people stopped hiring illegals then Americans would be doing those jobs. Not to mention that illegals ARE getting paid and NOT paying any taxes like the rest of us have to do.

She cannot have a gross income of more than 3.400
You have to have provided over half of her entire support.
You cannot be a dependent or if married filing jointly your spouse cannot be a dependent.
Generally, if you are a nonresident alien (other than a resident of Canada or Mexico, or certain residents of India or Korea), you can qualify for only one personal exemption for yourself. You cannot claim exemptions for a spouse or dependents.

Yes you can claim her if you have all your reciepts showing that you sent her money every month to pay half her living expenses. If she doesn't have a Itin number though you will have a $50.fine for this I know my ex used to claim both his mom and dad every year because we was supporting them. And all you idiots out there saying stuppid stuff think about it he's not an illigal cause if he was he would not be filling income tax in the first place there are alot of legal imigrants here also that have not forgotten thier families back home or where they came from just because they have thier papers now so get real if he wants to take care of his parents he's just giving back what they gave him in life Love and understanding! Something alot of us here in the USA don't even understand we put our loved ones in nursing homes or let them live on the street knowing that there is always something we can do about it and yet still we don't so shut up! |
