If he is living at home and you are providing more than half his living expenses: food, clothing, shelter, healthcare or health insurance - and can provide receipts to prove it if requested by the IRS in the event you are audited, then Yes you can claim him as a dependent. He still must file his own tax return, however, indicating on it that he is declared as a dependent by someone else, and he will receive any refund to which he may be entitled. |

If he lived with you for over half the year, and he didn't provide over half of his own support, you can most likely claim him. He can still file and get a refund if he has one coming, but can't claim an exemption for himself. A dependent is required to file if he makes over $5450, so he has to file if he is your dependent. |

If he lives with you, the question is whether or not he provided more than half of his own support (including his share of room and board).
If the answer is he supported himself, you can't and he gets all his federal income tax withheld back.
If the answer is no, he didn't, because he's UNDER 19, you can still claim him and his tax bill will be about $305.
Next year the answer is different. |

You can claim him if he lived with you for more than half the year and you provided more than half of his support. If he lived with you for more than half the year, you can usually pretty easily prove you provided more than half of his support- since if he were on his own, he'd have to pay rent, which is usually one's largest expense.
However, if he paid you rent, then you may not be able to prove you provided more than half of his support.
But if he's living with you, and has been, then you can usually claim him. This will change, however, next year. When he's 19, he'll have to be a full-time student in order for you to be able to claim him (until he's 24).
Regardless of the circumstances, he can't claim his own exemption, so make sure he checks the box "can be claimed as a dependent on another return" if you do, indeed, claim him on your own.

Since he is not a student, probably not both simultaneously. See an accountant in your state for particulars for both federal and state taxation laws and their interpretation. |

He will have the standard deduction of 5450. You have his exemption. His taxable income is his total income minus 5450. His tax is 10% of that. Take whatever taxes he paid in and subtract the 10% and that is refund. If not, then he will owe. |
