Can I claim my son as a dependent if his mother already has?
My taxes aren't being accepted by the IRS, because my son was already claimed by his mother. I pay for all of the child care, etc. We were never married, and live in seperate houses. What are my options if any? Can their only be one parent that can claim him?

We each have him 50 percent of the time, every other week.

Only one of you can claim the child as a dependent. Never having been married you may have an issue common to men in that you name may not be on the birth certificate. In that case you have a paternity issue to resolve before even starting on the tax issue. If you are on the birth certificate you would need to file a paper return and prove that you are the eligible parent if in fact you are.

You cannot both claim him as a dependent. if you pay for the majority of his costs, its probably time for legal action.

You cannot both claim him. Before next year you need to get into court and get a custody, child support agreement. It will include who gets to claim him, probably every other year.

Each child can only be claimed once.

If the child lives with his mother than she gets to claim him unless she assigns that right to you.

Yes, only one parent can claim the child. If he spends EXACTLY the same amount of time in each home, then the parent with the higher AGI gets the exemption - if that's you, file by mail and claim him. If he spends more time with his mom, then she gets the exemption. The IRS will investigate and determine who gets the exemption.

You cannot claim a child twice. You may wish to pursue legal action against the mother but that's of no concern to the IRS. Perhaps it is time for an attorney???

Read the IRS website on this subject to see if you meet the requirements to claim him. If you think you do, file your return VIA MAIL. The IRS will then contact both parties whom claimed him and ask for documentation to prove the claim.

No, you both cannot claim the child. Really, the parent who provides MAJORITY of the child's support (everyday expenses like food costs, clothing, etc) is the parent that should claim the child and receive the deduction.

Only one person can claim a child. If you pay the majority of expenses i would get a lawyer and take it to court. A court can decide who claims a child. If you do this and win then next year you would be able to claim the child.
