Can I claim my son on my taxes?
My son who is 20 years old was full time college student until September 2007. Unforunately he had to drop out of college due to lack of funds (grants didn't cover it and loans were not a optition). He worked part time throughout the year and made about eight to ten thousand dollars. He lived with me until September (well at the dorm and home) in September when he dropped out to go to work full time he moved in with his girlfriend. Can I claim him? My friend tells me no that he had to "live" with me all year and be a full-time student the entire year and have no job. I don't think that is right. He made the bulk of his money after dropping out of school.

I checked with H&R Block and Liberty, they said since he was a full-time Student from Jan 07 to Sept 07 he qualified as a Student and I did support him mostly from January-September that I could claim. I realize I can no longer claim after that thanks guys for your help!

I believe that there is a time limit on how long?? In terms of schooling. There should be a booklet available for you to research into. OR......... contact H&R? I think you are right. Ten months as a student and the low amount of income should still keep him in the bracket as a dependant.

If he was a "full time student" for 5 months of the year, he satisifies the "full time student" requirement. And if, in addition, you paid more than half of his "support", you can claim him as a dependant. I think the "support" calculation is the most complicated, as you are not supplying his housing for the last few months of the year.

Your friends aren't correct - he'd have had to live with you for over HALF of the year, and be a full time student for some part of each of at least 5 months.

The issue will probably be whether he provided over half of his own support. If he did, you can't claim him, otherwise you can.

If he was a full time student and you provided over half of his support, you might be able to claim him, but he must not claim himself. If he does, then you cannot. How much money he made also comes into play. If he moved in with his girlfriend that adds a wrinkle as well. My guess is that he will claim himself. Ya'll need to communicate about this and see a tax pro (CPA or Enrolled Agent).

The issue is whether he provided more than half of his own support for the year, not if you provided more than half. When he lived with his girlfriend, who paid for the bills there? If they split expenses, chances are that he DID NOT support himself more than 50% for the year.

In that case, he would be your dependent.

Assuming he was in school jan - may, & sept you meet the definition of full time student (requirement is 5 months). You can claim him this year but next year you can't. He also has to file - check yes that he can be claimed as a dependent (which means he doesn't get his own exemption you do). Hope that helps.

He has to have lived with you the entire year, and you have to have provided more than half of his support.

No you cant! He has to be legally dependant.. This means he depends on you..as in without you he would not be getting by. Providing your child with a bed food and electricity does not make them a dependant.Also if he claims himself you are the one that gets in trouble for also claiming him because he is a 20yr old adult.
