My roommate is telling me I should claim her on my taxes because she hasn't made much money in 2007. She worked for maybe 4-6 months of the year. Is it possible to claim her and how would that work? Additional Details We are not domestic partners she has been ill and unable to work. No family so I have been a friend and helped her out. Thank you all for your input. :) |

It's difficult to claim a roommate for taxes because you still must meet all 5 dependency tests. (Including gross income of less than $3400 and showing that you provided more than 1/2 of her TOTAL support.)
Even if you can claim your roommate (if she worked 4 months, I'm willing to bet she made more than $3400), it still wouldn't qualify you for head of household. |

Did you live together all year?
Is her income under $3400 for all of 2007?
Did she provide less than half of her own support for 2007?
If any of the above questions is "No", then no you can't claim her. |

If she made over $3400 gross for the year, no you can't - and if she worked 4-6 months, she most likely did.
If her gross income was under $3400, AND she lived with you all year, AND you provided over half of her support for the year, AND you meet a few other requirements, you probably can.
But given that she worked for 1/3 to 1/2 of the year, not likely. |

Unless your roommate is a retard and can never work and somehow you can claim that person as a dependent. Unemployment is not an excuse to be dependent on someone. |

If your not related or married then no. Domestic partnership is not recognized in many states. In the state of new york My fiance and I have lived together for 5 years and because we dont have the piece of paper we have to file seperately. |

Unless your room mate qualifies as a "dependent" there's no way. A dependent would have to be a child or close relative for whom you can prove you have provided more than 50% of their living expenses. |
