Since she was just born in 2008, nobody can claim her for 2007 taxes, the ones we'll be filing over the next few months.
For 2008, the taxes you'll file in early 2009, if your niece lives with you for over half the year and her mom doesn't claim her, you most likely can. |

You would not be able to claim her b/c she was born in 2008 and you will be filing 2007 taxes. You would have to wait until next year to claim her on 2008 taxes. Also, you have to prove that you are her primary provider and not your sister. If your sister is currently not working on the tax year that you are filing, then proving it should not be difficult. However, she has to be living with you for at least 6 months prior to filing and you have to be able to prove that you provide over 50% care of your niece. Congratulations on becoming an aunt! You cannot claim a child that was born in 2008 on your 2007 taxes. That includes your niece that was born on January 3, 2008 (congrats on the newborn).
As for if you would be able to claim the child on your taxes, if you did not provide any support and do not have custody of the child, you probably could not claim her. You cannot just give out children to other family members so they can claim them. The IRS has criteria as to who can and cannot claim a child. |
