Can I file an admendment for my 2004 tax return and reviece the corrected amount in 2009? ?
I know that the cut off is supposrd to be 3 years but I (like many others) was misled in believing that my daughter couldn't be claimed as a dependant because she didn't "live" with me for hald the year since she was borb November 29, 2004.

Dear Jenn: You are correct 3 years if you filed on time for 2004. Sometimes the IRS in special situations will extend or over look certain rules. You must have proof that you were misled i.e. you called the IRS and ask an agent and you relied on that information. You will have to have dates names etc. If you relied on a friend or something you heard on the radio your grounds are very weak.

If you feel you have a strong case file an amended return and include a letter with your case outlined in a letter attached to the return.

Sorry, but the 3 year rule is cast in stone except in the most unusual circumstances such as being in an extended coma or military personnel deployed in a hostile file zone for an extended period of time.

Many folks don't fully read the instructions on the rules for claiming a child, most importantly the one about a child that is born (or dies) during the year. That very question gets asked here many times each tax season (and is often answered incorrectly by folks who claim to be tax pros) but the answer is right there in the instructions. The IRS won't entertain waivers of the 3 year rule for failure to read the directions. Sorry.

as stated earlier..you are correct 3 yrs is the cut off...but here is an additional bit of info..in the front pages of the irs code (in your 1040 instructions)...it clearly states that "ignorance is not a defense"...even if married and spouse abuses tax code....so no you can not amend and get 'credit'...let it go.

No I'm sorry, the IRS will not send refunds on a 2004 tax return after April 15, 2008.

You can file amended tax return for 2004 but you will not get any refund. The last date was April 15, 2008.

If you have refund on 2005 tax return, you must file original or amended tax return on or before April 15, 2009.

You're right, the cutoff is three years. You won't be able to get a refund from 2004.

Get an official answer from an IRS staffer. You can ask all the questions you have and maybe someone will be helpful and
suggest an avenue to pursue.
