Can I file head of household?
My g/f and I have 2 kids. One is hers and the second is ours. We live at her parents house and split the bills. We both work full time, she's under the table, I'm ½/yr 1099, other ½ W2 / Can I file for head of household even though we live at her parents? What would be more beneficial in this situation?

The four requirements that must be met are:
1) The taxpayer is not married at the end of the year.
2) The taxpayer paid more than half the cost of keeping up his or her home.
3) The home was the principal residence for more than half the year for a qualifying child or relative.
4) The taxpayer is a US citizen or resident for the entire year.

You fail on point No. 2.

Heck no. It's their house. The odds of you, by yourself, being able to PROVE to IRS satisfaction that you paid for more than half of everything are low. Do you really want to be in an audit and trying to argue that you paid more than half even though your g/f's dad's name is on the electric bill and it looks like he paid all of it?

Your g/f files as single. She claims one or both children. She is going to owe 15.3% of SE tax on her "under the table income"--if that same income qualifies her for EIC, she had better put her records proving that the had the income in a safe place as the IRS is going to want to see them.

You file as single. You can claim your bio-child, but only if she doesn't. If you both want to, the person with the highest AGI wins. If the SE income also qualifies you for EIC, get your proof together as well.

Alternately, you and she file as single, no kids. Then you let the grandparents claim them.

You can only file head of household if you are providing over half the cost of maintaining the residence. If they own the house, unless you are paying a lot of rent to them in addition to just splitting the bills, doesn't sound likely. It isn't a matter of what is "beneficial", it's a matter of what's legal.

And of course you realize that even if her income comes in "under the table" she is legally required to claim it on a tax return and pay tax on it.

You cannot file head of household. I think you may have to file as a single person.

Head of household status is a single person supporting themselves and a qualifying child on their own income. You don't qualify for a whole bunch of different reasons.

I believe she can on hers, but I don't believe you can on yours; however, Check out IRS.gov It should give you your answers and if the question and answer part doesn't include the info. Call the IRS direct. Good luck

If you are providing more than 50% of the household costs...yes. You also can file single, with dependents...so you can still take advantage of the child credit and personal exemptions.
