A married taxpayer is required to file a tax return if his gross income from wages is $3,500 or more.
If your spouse is not required to file a tax return, and does not file, your filing status is married filing separately. If you file as married filing separately, you do not include your spouse's income on your tax return.
If you file a joint return, whether your spouse alone is required to file or not, all income from both spouses is included on the return. |

A joint return means that you include all of both people's incomes.
You can file as married filing separately if for some reason you don't want to file a joint return, but you'll almost surely pay more tax that way.
You can't have it both ways. |

It is a common misconception that small amounts can be ignored. |

You can file separate but married instead of joint....but this rarely saves you money and usually ends up costing you more. There are time when filing this way is to your benefit...especially if there is a great disparity in income between you. If you're considering this, best suggestion is to speak with an accountant who can review your circumstances and advise you which is the best way to go (or you can use a program like Turbo-tax or Tax-cut and work it both ways.) |

What your husband's earnings were in 2008 is irrelevant. He is still required to file a return. Furthermore he still, unless you itemize, will get a standard deduction and personal exemption which will lower your taxable income. You should file a joint return. |
