No, if you aren't married, you can't file as married filing jointly. And I think you have calculated something wrong if there is that big of a swing in the amounts.
If he made under $3400 total for the year, there would be a chance that you could claim him as a dependent, but if he worked 7 months he almost surely made more than that even if he only worked part time. |

The IRS would recognize a common law marriage but you're in the wrong state:
"Common law marriage is not legal in California; however, California does recognize common law marriages that are valid in other states. In fact, California is obligated by the Constitution of the United States to give full faith and credit to any marriage recognized by any other state. Legal marriage in California requires obtaining a marriage license and exchanging vows before an official authorized to formalize the vows. No. You have to be legally married to file as married. If you supported him for more than 50% of the year and can prove it, then you can claim him as a dependent.
Without a marriage licence though you are technically single. |

If California recognizes common-law marriage you can, but it means you are representing yourself as married and that opens you up to legal problems if you split and one person or the other wants some settlement.
If you are going to get married this year, you could file married and nobody will know or care, but it's not lawful. |
