Can I file taxes twice?
I changed my job mid last year and got a new one. I have only received one W2 form.
Can I file taxes with the one W2 I've received, and then file again when i get the second one?

chatsplas
You could, but why would you--asking for trouble?
The IRS crosschecks W-2s received and tax returns and might decide to really look at your return.
If they let it pass, later you'll receive a letter demanding more money from them and telling how they refigured your taxes.
Call the employer and ask them when they're available, if they're online. They have to be mailed by end of month.
You only file your 1040 once, then you have to file an amended return 1040X. Filing once is bad enough, why do it twice? And if you have it done, there are fees each time.

Wait for the second W2.

Technically, filing with only the one would be illegal as you are knowingly filing a false return.

NO.

Wait for the second W-2.
If you file with the first one, you have to AMEND for the second one. An amended return is a pain to do, takes 8-12 weeks to process and a professional tax preparer will charge you at least $100 to fill it out. (The IRS does not help you fill these out over the phone.)

firewife
well you could file now and then file and amended return, but that is way more hassel than you really want to deal with. Why not just wait. Employers are required to have W-2s in the mail by january 31.

Probably best not to. What you can do is use your last pay stub in lieu of your W*2 form. That being said had you filed a return and forgotten to report income you can go back and file a 1040X form and amend your return.

Right now I would try and contact the employer and secure the W-2

Read the fine print above where you sign. I quoted it below the link.

http://www.irs.gov/pub/irs-pdf/f1040.pdf

"Under penalties of perjury, I declare that I have examined this return and accompanying schedules and statements, and to the best of my knowledge and
belief, they are true, correct, and complete. Declaration of preparer (other than taxpayer) is based on all information of which preparer has any knowledge."

When you sign the return knowing that you have more w-2s coming, you are committing tax fraud and perjury.

You can file a corrected filing later, but why not just wait and file with both W-2s, that would just be easier and less likely to cause problems.

Dear otieno65,

The answer to your question is yes, however, as you can see most people are advising you to wait. As a professional, I would tend to agree with them. What you could do is call up the company that has not sent you a W-2 and tell them you need it to file your return. If you get the payroll department (ask for them), find out when the W-2's were sent out. It is possible they sent them to the wrong address. Or, they may have your name wrong and it was returned to them. In either case, verify when it was sent out and when the expected date of your receipt of them is. You should receive them by 1/31 or first week in February (this is by law). So be a little patient.

If in fact there was an error, they may be able to fax you a copy if you can prove it's you over the phone (this depends on the company and how convincing you are).

I hope this was helpful to you!

Yes it is called an addendum, however if you get money and then when the other one comes and you owe, you will owe IRS with principle and interest.
