I worked with a company for 6 or 7 years. I had an excellent relationship with all my supervisor and co-workers. I moved to another state and the commute was on average an hour and a half (sometimes 2 or more). So I found a job closer to home. My last employer is trying to register me as an independent contractor. The IRS is reviewing this and will make a decision in 120-140 days. The unemployment office in my state, explained that my benefit period is for the year before. Am I eligible for unemployment. I've read a couple different articles and they've lead me to believe I am. I have a hearing tomorrow.

I quit my job with my employer after 6 or 7 years for another job. I was fired from that job after my employer attempted to register me as an independent contractor. My benefit period based on the previous year, which would have been with my old employer. |

Since you were fired from your most recent job, it might be possible to get unemployment if you are found to actually be their employee. If you were legally a contractor with them, no. |

In California, you can only collect if you were fired for a legitamate reason (not being fired for doing something intentionally) and the EDD does investigate |

In nearly evey instance you qualify for unemployment if they let you go (due to no fault of your own) not when you quit.
The only exceptions would be if you quit under duress or quit to avoid a threatening workplace but that would require an oversight decision and possibly even an EEOC hearing. |

if you QUIT your job, they wont give you EI unless you have a really good excuse. my bf quit his job from away to come home to watch the baby while i was in school and they denied him. he even appealed it explaining the situation and they still wouldnt give him anything :

In Most places, if you are unwillingly terminated from your job, then you can recieve unemployment, since you were not ready to be with out a job and a source of income.
but if you quit then they see that as you planning a departure from your place of work, and you planned on having another source of income.
