No, you can not. Alimony or separate maintenance must be part of a formal divorce or separation decree as approved by or ordered by the courts. Unless there is a court order there is no alimony.
Why would you want to do that anyway? You'd have to pay taxes on it and since no taxes would have been withheld on it, you could owe a FORTUNE on it.
Edit: You obviously don't understand how alimony works. Your husband deducts it from his income and gets a tax break on it. YOU must pay taxes on any alimony that you receive. But without a court order there is no alimony.
If you want alimony as part of your divorce settment, consult with your divorce lawyer. Not all states award alimony anyway so it may not even be an option. But if you get it, be SURE to set aside enough to pay your taxes on it! |

Only if you have a court order that he pay you that amount AND that it is specifically designated as alimony and he actually paid it to you. He gets to write it off on his return. |

Uhm, you need to declare your actual income. That means any money you earned from working, plus any money your husband paid to you as alimony. Ask your tax advisor about this.
Lying on your tax forms is illegal, and will cause huge problems for you, the least of which will be a long and painful audit. |

No you can't and why would you be able to do that unless the amount received was, in actuality, 50% of his gross or net income? Can you prove this is what you received? It doesn't matter if you've been separated for years and that you will divorce shortly. The "alimony" you've been receiving, if it was decided by the courts and agreed to, does not automatically continue at or after the time of divorce unless stipulated.
Edit: So, then, you're simply calling it alimony and it wasn't part of the separation agreement since there wasn't one of those either! You probably should have been filing joint taxes as well in order to realize some savings there. I think you need a good lawyer at this point before you go in there and try to claim ignorance as an excuse for not knowing the law! |

Unfortunately, the IRS knows most of the tax scams. If you want to play that game be prepared to pay the consequences if caught. That along with fines and penalties will more than make up for what you benefited. |

Just an opinion here, as I have not checked the facts but you should do so before you get in to trouble here.
I think only what you actually put in your bank account counts as your income. Did you actually get alimony? Sounds to me like it was a case that should be married and filing jointly for now. But get a tax accountant and make sure. |
