No you can file as "married, filing seperate" |

If you are married you have two filing status that you can use, Married Filing Jointly or Married Filing Separately. If you have children and did not live with your spouse at any time during the last six months of the year you can file as Head of Household. Single is not an option. |

If you were married as of 12-31 you have 2 filing status options, and possibly 3. You cannot file as single, and there is no such filing status as "married-single."
The 2 choices are married filing joint (MFJ) and married filing separate (MFS). For the vast majority of couples MFJ is the most favorable, but you have to work the numbers both ways in order to make sure which is best for you.
The third possibility is Head of Household. If you have a child in the home and lived apart from your spouse for the last 6 months of the year, you may be able to file as HOH. |

I thought it had to be "married filing separately"? |

If you are married you can't file as single whether or not you are living with your husband. If you have been separated since June 30. 2007 or earlier, and you provided over half of the cost of keeping up a home for your eligible child, you might be able to file as head of household. Otherwise you can file a joint return, or can file as married filing separately.
TurboTax will almost surely show you a better refund filing as single than as married filing separately. The only problem there is that you are NOT single so you can't legally file that way. You don't really want to get involved with tax fraud, do you? |

you can file as "married, but filing separately" ... this is fairly common if one spouse is not a US citizen.
tax tables and deductions are somewhat different than single. |

Sorry. You have to file either married filing jointly or separately. The single person return would save some taxes but you have no legal choice on this. This is called the marriage penalty if you ever heard of it. |

Here is the scoop. If you husband has not lived with you for the last 6 months of the year then you are considered single for tax purposes. Otherwise you have two choices married filing joint or married filing separate. Please keep in mind that if you file married filing separate you pretty much loose all most all of your deductions, you don't get squat. Only use as a last resort. To be honest, married filing joint will get you the biggest deductions.
If your husband has not lived with you in the last 6 months of the year and you have a child who lived with you all year then you may claim Head of Household provided other conditions are met |

well you can't file as single.
you can file: married, filing single
or if you meet the requirements you could file as :head of household
get a tax book and read the requirements, take the time to get informed, better to be safe then sorry, the IRS is not someone you want to get things wrong with. |

If you live alone or single you can file as "single". If you are still living with your X, you cant by law. |
