PlasticTrees | Can I still file for my tax refund from '05? |
Long story short, the s%%%ty business I worked for never sent me a duplicate w2. I tried endlessly for 6 months and they don't return phone calls--if they did it would be considered "their job".
So anyway, the places I worked in '05.. can I still file? I've read that you have 2 years. If so, where can I download the 1040EZ form for that year? Additional Details I have no idea why I asked "where do I download the form". |

You can still file 2005 tax return. If you owe money there is no time limit to file a return. If you are owed money you have 3 years from the original due date of the return to file and get the return, or 3 years from the extended due date if you filed for an extension. So for your 2005 income tax return, you would have until April 15, 2009 or October 15, 2009 (if you had filed an extension) to file the return and claim the refund. You can go to www.irs.gov to download any forms you need. As far as electronically filing, you would have had to file the return by October 15, 2006 to be able to electronically. So you will have to paper file your 2005 tax return, but you can get your refund direct deposited. You must include the W-2s from every job you had for 2005. If you don't have the missing W-2, call the IRS and tell them you have a missing W-2; you should have done that back in 2006. They will help you with getting the missing W-2 or some other documentation. |

You will have to go to IRS/GOV and download the form to paper file with. You can file 05 electronically this late in the game. You should also attach an explanation as to why you are so late and ask that no penalty be assessed. If you need any specific help or questions answered contact me; I've worked taxes for the IRS VITA program for 36 years. |

You have three years, not just two, so yes, you're fine and will still get your refund. Download the 1040EZ at http://www.irs.gov/pub/irs-prior/f1040ez--2005.pdf and the instructions at http://www.irs.gov/pub/irs-prior/i1040ez--2005.pdf
You'll have to mail them in - it's too late to file electronically for 2005. You can still do direct deposit. |

You can file the return at any time. You MUST include the W-2s from ALL jobs. If you don't have the missing W-2, call the IRS and file a missing W-2 complaint; you should have done that back in Feb of 2006, by the way. They'll assist you in either securing the missing W-2 or generating alternative documentation.
If you are due a refund you have 3 years from the filing deadline to file and claim the refund. For tax year 2005, that will be April 15, 2009.
You must file a paper return. The deadline for e-filing tax year 2005 was in October of 2006. |

Yes, you can file your 2005 return.
The rule is if you owe taxes, or you meet filing requirement then you must file.
If you expect a refund then you must file by April 15, 2009 (within three years of your regular date of return) otherwise you will not get the refund money.
This is the link to get forms for the year 2005:

IF YOU DO NOT HAVE YOUR INFORMATION YOU CAN GET IT FROM THE IRS. YOU MUST FILE ALL TAX RETURNS NO MATTER HOW LATE. YOU COULD STILL GET A TAX REFUND BUT PENALTIES AND INTEREST WILL DEDUCT FROM THAT. YOU CAN GET ALL FORMS STRAIGHT FROM IRS.GOV. AND NO YOU HAVE 3 YEARS TO GO BACK AND GET YOUR REFUND. PERSONALLY I WOULD REPORT THE EMPLOYER THAT WOULD NOT SEND YOU YOUR W2'S. A FEDERAL RULE IS THAT AN EMPLOYER HAS 30 DAYS TO SEND YOU YOUR INFORMATION AS LONG AS YOUR MAILING INFORMATION HAS NOT CHANGE. |

if you can't download the form call 1-800-829-3676 and they will send the forms you need. Call 1-800-829-1040 and request any w2 you may need.
And for the future if you don't receive your W2 after the 31st of Jan, you need to contact IRS and let them know so that IRS can send a letter to your employer and get the W2 for you.
Only current year tax return can be direct deposit,
so sooner you file the better. |
