If you don't live at home but on your own and DON'T have an agreement with him on claiming you, claim yourself on your taxes. He shouldn't claim you as a dependent. He will be the one in trouble if you both claim you as a dependent.

The only way you can claim yourself is to actually file a tax return and take your own exemption. If someone else has already claimed you, you have to file using a paper return (rather than e-file).

The IRS will ultimately request information from both of you to see who should be able to take your exemption. The qualifications are pretty clearcut...you wanting to get a stimulus rebate, or you simply feeling like you should get to claim yourself, are not factors in the IRS decision.

Back when I was young, I would have MUCH rather had the financial support of my parents than the measly $300 you would get from the IRS. :)

First question did you live at home, the home he provided?
Next did you have an income, an income more that 3K? If not you would not even get the minimum of $300, if you did not pay at least $600 in taxes you would not receive that amount, somehow by reading your post do not think you even made the 3K.
Next if you want to file independently, be independent, get your own job, your own place pay all your own bills, as in get emancipated. Your dad did not F you over you more likely appear to be a a spoiled I want everything for myself without giving a care for anyone else, or the reality of the facts.. Sorry just as it appears in your writing. Yep want my free money though I did not earn it. Read up on the rules of the rebate and see if you wold even qualify for it before you pass judgment my guess is you would not.

1. An amended return will not get you the stimulus check.
2. If your dad is entitled to claim you, then you can't claim yourself. This was never a choice issue, but a facts issue. If your dad was *not* entitled to claim you, you should amend.

If you don't get any money this year, but are eligible when you file your 2008 return, you *might* get some money then.

the only way would be for your father to send in an amendment unclaiming you, which I doubt he'll do.

Who paid th4e majority of your support during calendar year 2007? That person is entitled to claim you as a dependent, and ONLY that person. That is the law, period, no discussion.

If you did NOT file a tax return for 2007, there is no way you can get a stimulus payment. Those payments go to taxpayers.

Welcome to my world, i'm 19 go to college live at home pay 600 dollars rent every month buy my own groceries pay for my internet and cable work full time and go to school full time and my dad did the same thing by claiming me and on my return i didnt file able to be claimed so my dad made me file an amended return which took 4ever and now i wont get a stimulus either it really is bullshit. **** the IRS ! (Internal Rape Service)
