The love of my life is really great guy and i wanted to know if he cloud claim his 2 kids on his taxes?( its not about child support ok) but he does pay a least $700 a month for both his kids and it's not a problem form him to do so. There his kids his baby mama does not want him 2 see the kids or spend time with them . The custodial parent gets the exemptions by law. If she relinquishes it by completing a Form 8332, only then can he claim them. If she does give him that form, he must attach it to his tax return. He may then claim the exemptions for the child or children, plus the Child Tax Credit. He can NOT claim the EIC or file as Head of Household though; she retains that right in any case. (She can give him the exemptions for one or both of the kids. Splitting them is pretty common practice, as is switching off each year.) If she refuses to give him the form, he's SOL.
Issues on support, visitation, etc. have no bearing on claiming the children on his tax return. His only recourse with those issues is through the courts to force the mother to comply with any visitation orders. |

The IRS rules default to the custodial parent.
If she wants to claim the children she wins. If she chooses to let him claim the children, she can, but she must sign this right over using form 8332. If your boyfriend has the form attached to his tax return, he can claim the dependency exemption and the child tax credit. (The custodial parent retains child care and EIC.)
If she *doesn't* sign the form, he's out of luck.

He would need a written statement from her saying he has permission to claim them on the taxes, which means she can't claim them. Doesn't sound like thats going to happen. |

I assume from your question that his children live with their mom. He can't claim them unless he has either a valid court order saying that he can, or her written permission. |

He should have raised this issue back in September when he was in court for an increase in child support. He should also have raised the issue of lack of visitation rights. If his lawyer didn't raise either of these issues, he needs a new lawyer.
If she is only making about $850 a month in her job and he pays $700 a month in support, he deserves to have at least one child as a dependent. But, this will have to be negotiated through the court since she obviously is not a reasonable person. He can't just decide to do it on his own and expect it to work - the law gives the dependent to the custodial parent. |
