now, girlfriends can be dependents. you would qualify under "qualifying relative"...just look up all the rules to see if you meet all of them.

Probably.

As long as you live together all year and you have under $3500 in income for the whole year. To the best of my knowledge, NY doesn't have any laws against cohabitation.

Note: He does not qualify for Head of Household. He would file as "Single" with two exemptions.

Why do people answer with no knowledge or even a bit of research? The answer is Probably Yes, you can be claimed as a dependent on your boyfriend's taxes. The definition of relative is:

152 (d) Qualifying relative
For purposes of this section— (1) In general
The term “qualifying relative” means, with respect to any taxpayer for any taxable year, an individual—
(A) who bears a relationship to the taxpayer described in paragraph (2)...

(2) Relationship
For purposes of paragraph (1)(A), an individual bears a relationship to the taxpayer described in this paragraph if the individual is any of the following with respect to the taxpayer...
(H) An individual (other than an individual who at any time during the taxable year was the spouse, determined without regard to section 7703, of the taxpayer) who, for the taxable year of the taxpayer, has the same principal place of abode as the taxpayer and is a member of the taxpayer’s household.

So you are a member of his household, not a spouse. Therefore you are a relative. From there, you look at citizenship, amount of support, etc. But according to the IRS, for tax purposes you are a relative.

When your bf files his taxes for 2008, he can claim you as a dependent if:

1. You lived with him all year in 2008
2. You had income subject to tax of less than $3,500
3. He provided over half of your support.

If you lived together ALL year, not just most of it, and if he provided over half of your total support for the year, and if your gross income for the year was under $3500, he might be able to claim you. But if your relationship is illegal where you live, then he can't. There are several states, plus some additional smaller areas, where cohabitation by an unmarried couple is illegal. Even if the laws haven't been enforced for years, if they're still on the books he can't claim you.

No, he can't. Even if he supports you, you do not meet the qualifications as a dependent. A dependent is either a qualifying child or qualifying relative. You are neither.
