Rachel | Can a 17-year-old move out of their house legally before turning 18 in NC? |
I am a 17-year-old girl living in NC and I wanted to know if i can legally move out if I only have 5 months till I turn 18. I am not only moving out to just have freedom, my home life is terrible. My home-life is absolutely dreadful, my mom is trying to send me away but I do not do anything wrong. I am a senior in high school, make straight A's and everyone that knows me as a picture perfect daughter. I need a way out of this situation. So, if i get a job, have a place to live, have a car, can i legally move out at 17 & 6 months old. |

you can move out, but where would you go? you cannot legally get a credit card, you cannot buy a car, you cannot rent an apartment, your parents are still responsible for you.
talk to your school councilor |

Rachel, I know this isn't what you want to hear, but stay at least until you graduate. Out of a lifetime, those additional months aren't a lot, even though right now it seems like forever.
If you are living on your own and trying to pay all of your own bills, there's a good chance you'll end up dropping out - even in NC it's expensive to live on your own. You've worked too hard for all those A's to mess it up now. Stay and graduate, and see what financial aid you can round up for college.
Good luck. |

I would like to hear your moms side of this as well, because any child that is as picture perfect as you are must have a mother with a mental illness if she is trying to send you away. If your mom has some sort of illness I find it hard to imagine that this just began. So this turmoil must have been going on for years. In my experience any child in that much turmoil is not "picture perfect" because living with that creates behavioral and emotional issues for the child.
My advise: Get a job save your money for the remaining 6 months, get a car and when you turn 18 then move out.
If she send you away then wouldn't that be better than living with her because it seems pretty clear you don't want to live there. |

No one is going to rent an apartment or house to a 17 yr old- you aren't old enough (18 is legally adult) to sign any legal documents yet, like an apartment lease (plus you would need 2-3 months worth of rent just to move in, plus security deposits for the utilities since you have no credit history) and if you're in highschool , how could you possibly make enough money to afford an apartment, utilities, car, car insurance, food, gas, etc? |

Sorry, NO. Legally you are a minor, and under your parents' control. How about your father or other relatives? Can you live with some one else until age 18. You don't want to hear this, but you're ALMOST there, suck it up and stick it out. FINISH school, graduate, school is your number 1 job right now. Get yourself an afterschool job to keep you busy and out of the house. If your mother is trying to send you away, where to and why? Glad to hear you're a good kid and great student, but no 17 year old is "picture perfect daughter who doesn't do anything wrong", there are two sides to every situation. Legally you can't sign a contract that isn't voidable, including a lease.
TALK to your school counselor, social worker for advice, perspective. |

You can legally move out without your parents’ permission when you are 18 years old. "Adult" means a person who is eighteen years of age or older.Depending upon your home situation, you could try to seek help to improve your relationship with your parents. However, if you are trying to leave home due to an abusive situation, do not wait - call for immediate assistance

im not sure if its legal in your state or not, might wanna do more research on it, but as far as i know, as long as you have a steady income, yes you can legally live on your own at 17. |

With your parents permission, yes.
But since you only have 5 months to go - if you can manage the details, just do it. It's hard to get a job at 17 that will pay for a car, insurance, gas, rent, utilities, and food. But if you can find a way to do it - go for it. The only way you could be stopped is if your parent tried to do that - but if your mom is trying to send you away, I get the feeling she wouldn't try all that hard to force you back home for only a few months.
Legally, you can petition to become an "emancipated minor", but I'm not sure of all the hoops you'd have to jump through to accomplish that. And since you only have a few months to go, it would only be worth going through if you can't find someone to rent to you on your own. (the "emacipated minor" status will give you the legal status of an adult.
It might be easier to see if you can find a friend who's a year or two older, and already has an apartment, and see if they'll let you move in as a roommate.
Either way (staying at home, or leaving), I recommend getting your high school diploma. It will make things easier down the road. |
