 Tax rebate?....is it UNFAIR for single parent to get less compare for married couple..if the governmenr really

Can a disabled relative be claimed on taxes?
My brother was born with a severe birth defect called Cloacal Bladder exstrophy. As a result he was given a surgical procedure where his ureturs from his kidneys were tied internally to his colorectal area. He also has a severe learning disability and his IQ was deemed very low at an early age to the point of him being placed in special education classes thruout school. When he was transferred to the 9th grade in high school, the school system failed to follow up on his special needs requirements and he was placed in regular classes with normally functioning peers. He lasted less than one school year and dropped out due to his learning deficiencies.

Since dropping out of high school he has managed to hold down several odd jobs over the past few years, but as he has aged his problem with incontinancy has increased dramatically due to the surgical procedure I spoke of above. He is now 35 years old, and requires trips to the bathroom on the order of every few minutes to prevent himself from having "accidents". His ability to hold a job has been severely impacted as a result due to employers not permitting him to take bathroom breaks as often as he requires.

This, coupled with his learning disability, has all but eliminated him from finding or holding a job as his condition worsens with each passing year. He has been living with me for the past 14 month and I have been his sole provider where food, clothing, shelter and neccessities are concerned.

We are currently awaiting the outcome of his social securrity disability application, and I need to know if I can claim him on my 2008 return since I am providing for him as I am.

I also need to know what, if anything, I can claim or deduct as expenses other than the standard exemption if I am indeed allowed to claim him.

Added for clarity: My brother has lived with me for all of 2008, has not worked nor earned any income since moving in with me. I'm also wondering about being able to file as Head of Household as well.

Yes, you can claim your brother as your dependent. You may also claim as an itemized deduction any medical expenses you pay for him that exceed 7.5% of your adjusted gross income. This includes hospitalization, insurance premiums, prescriptions, transportation to doctors and hospitals, etc.

You may also file as Head of Household, which increases your standard deduction.

From your information, you can claim your brother for 2008 and file as Head of Household. These tax benefits do not depend on his disability.

If he is permanently and totally disabled, he also qualifies to be your "qualifying child." The additional benefits of a "qualifying child" are

1. The Child Tax Credit (not available to you since your brother is over age 17)

2. The Dependent Care Credit (available to you if you paid someone to care for your brother while you worked).

3. Earned Income Credit (available as long as your income is less than the maximum, currently $33,241).

He qualifies to be classified as disabled for federal income tax purposes if his disability prevents him from working. Receiving SSDI is sufficient, but not necessary, for this classification.

I just want to add that I think you're pretty wonderful for taking care of your brother. If you need help with him, contact your local County Social Services office, and ask what services are available to you. Many disabled people and their caretakers are served by Regional Centers, which provide respite care, assistance with job placement and linkage to counseling and many other services that may be valuable to you and your brother.

If you are a support work I think you can claim thing you used for working. petrol, cleaning etc...

He had less than $3500 gross income for 2008, and he's your brother. If you provided over half of his total support for the year, then you can claim him. If for example some sort of public assistance provided his medical and that added up to more than your support, then you couldn't.

Sounds like you probably can claim him, at least as a qualifying relative. It's very possible that he meets the rules to be considered totally and permanently disabled - if so, you can claim him as a qualifying child. Either way, you'd get an exemption for him. Other expenses aren't deductible though, unless his and your total medical is over 7.5% of your income and you itemize - then you might get a tax deduction there. From your question, doesn't sound like that's the case.

Once you claim him as a dependent you can also deduct his medical expenses that you paid. It is subject to 7.5% of your agi. If there is a reimbursement of the medical expenses you deducted then you must add that reimbursement back as income.

Based on the facts that you have provided, if he is "permanently and totally disabled", unmarried, and either a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico, you can claim him. If his disability is less than total, you can claim him only if his gross income, including unearned income, is less than a certain dollar figure (approximately $3400; I am looking at last year's instructions and do not have the 2008 figure).

If you can claim him and paid over half the cost of keeping up the home, you can also file as head of household. If another member of the household (for example, your boyfriend or girlfriend) paid over half the cost of keeping up the home, then you cannot file as head of household.

Get IRS publication 501. Read it. Do the support test. If you meet all the tests, claim him.

If/when he gets social security disability payments you'll have to revisit the support test. If, for example, he gets $1000/month, you'd have to demonstrate that you spent $1001 a month.
