the non-technical answer is: Yes, if he meet the reqirements to claim them.

If the children don't live with him, he can only claim them if there is a valid court order saying that he can, or if the other parent that they DO live with gives him written permission to claim them and states that she won't.

Depends on what it says in your divorce settlement. If it is not stated, then it is not automatic that neither one of you get to claim. Child support is only set-up for the one paying it to pay their share of the expenses, not necessarily full support. If you and your ex-spouse are truly each paying half, then you should each claim one child as a dependent. If the ex-spouse is unemployed or on welfare to support the children, then the one paying child support should get both since he is the one actually working to improve his kids life.

To automatically be entitled to claim them, they have to live with you for more than half the year AND not provide more than half of their own support.

Absent of an agreement between the divorced man and his ex-wife, the parent with custody of the children for more of the year would be the one the IRS would recognize as able to claim the kids as dependents.

The IRS will let either of you claim them, but not both. If both of you claim them, the IRS rules will wind up allowing her to claim them, and the exemptions will be disallowed for you.

It depends on the divorce agreement who gets to claim the children. Check your divorce agreement. It will let you know whether you are your wife are claiming the children. If you are on good terms with her, call her and ask her.

Only if the divorce decree says so. If the divorce decree or other court filed paperwork has no mention of who gets to claim the child, then whom-ever the child "lived" with the majority of the year automatically gets to claim them. Also, be wary. If you are are allowed to claim the child via the court papers, you cannot use the child for head of household status, daycare expenses, or EIC. You will only get the child tax credit, because the child did not actually live with you.
