It is as much an offence NOT to submit returns as it is to falsify them, so either way you'll - to use your euphemism - "get nicked" ! ! ! |

That depends upon what returns you have failed to submit.
HMRC rarely take action against people who fail to submit personal tax returns, they just keep raising assessments until you're forced to submit.
However, failure to submit some returns can be a criminal offence, so if you haven't submitted wages returns etc you may be in trouble. |

You will get fined and penalised interest on any tax under paid. Only if you have been deliberately de-frauding the Government out of its taxes would criminal proceedings be likely. |

they don't nick you, they make up their own mind how much you owe and charge you interest until you pay
if it turns out that their guess is too low, although very unlikely, they will charge you interest on the amount you should have paid until it is paid

Re Income Tax
There is a fixed penalty of £100 initially followed by increasing amounts to the extent of daily fines.
My recent personal experience was that the tried to fine me £100 for not submitting a return they earlier told me not to submit! Fortunately I had the original letter |

That depends on what you mean by the tax man. If it is the one that you hire to do your paperwork then he is not liable and can't do anything other than to refuse to do more for you.
If you mean the Revenue service or tax collector for the government then that is yes they can put you in prison if the see fit to do so. Most of the time they let you put things straight but if you do not be honest then you can kiss your friends good by for several years.
It is easy to find out if you are not declaring funds that you receive from any government agency or most companies. |

The taxman won't nick you as such, and it is unlikely you will end up in jail unless you flout a judgement for payment when County Court proceedings are taken against you for non payment, then it would be for contempt of court, not witholding Tax Return. Interest charges and penalties for not submitting Tax Returns are high, and HMRC will take legal proceedings for an estimated tax liability plus the interest and penalties. If you leave it too long, you have no right of appeal against estimated liability, which will probably be excessive to any tax which may have been due on a Return. Depending on the amount of money involved, it may not be County Court, but could be distraint or enforced bankruptcy.
I would advise getting in your Tax Returns by the due dates if you want to avoid a lot of expense and hassle. |
