Can an employer cut your wage?
Just received letter confirming under Job evaluation my new banding and stand to loose £3000per year (current salary protected until April 09). What can I do? Anyone else been through same thing?

If you went to an employment law specialist then they will tell you with 100% accuracy what your rights are in this case.

Like another poster here has indicated, any evaluation HAS to be done with you so the employer knows exactly what your job involves.

Too many employers do not get proper legal advise before they undertake these moves, so you may well want to strike back at them with a solicitors letter outlining your legal rights.

Yes. An employer can use a job evaluation process, and it can result in some people losing out. Where employers often mess up with this is failing to adequately consult with staff and their unions.

Employers cannot just say they have evaluated your job, you have to have been consulted and involved in the process.

Do you have a union? Is there a published process?

they can do it but have to give you x ammount of time/notice

my company did the same to me i got 12 weeks notice

and my hours changed to i lost 30 of 38 hours night shift allowance = lost around £3800 a year

now looking for new job as i had/still been here 10 years and get treated like crap

Have you been working for the same company for a year? An employer can only cut wages if it is written into your contract (check) or you have agreed to the pay cut. I think a trip to the Citizens Advice Bureau might be in order all though if you are in a union contact them.

There are several things you can do about this, first say nothing and except that you boss does not value you, second leave and get a new job. Third as your employer under what criteria has he used to make this decision? Why were you not informed that there was the potential for you to get a reduction in your salary?
If your boss cannot answer these questions fully or you are unhappy with his answers the only thing you can do is approach CAB for legal advice. If you are a member of a trade union they will represent you.

If you are not in a trades union, I would ring ACAS for advice.

Check with your union if you belong to one, but I think employers have the right to lower your wage, although they have to issue you with a new contract of employment which you have to agree to and sign. There is also a time limit of thirty days which you will still be making the same wage. If your company is in financial trouble then it's up to you if you think this necessary, or are they just trying to pay their investors a bigger premium.

Can an employer cut your wage - yes, but only if they follow a precise process defined by law.

Cutting wages across the board is something employers are EXPLICITLY ASKED TO CONSIDER if the alternative is making some jobs redundant.

There is, however, a formal process that needs to be gone through, the employer needs to make you aware that a review will be carried out, you need to have been consulted (either individually or through a collective representative such as a union), and they need to have taken at least the minimum time periods for all these steps.

If they haven't, it is unlikely, however, that your appealing will help your career :-) What it may do is get you compensation if you leave and go to a worse paid job, or have otherwise suffered loss as a result.
