Can an employer deduct 1/2 hour lunch break from my pay, if i am part time and only working 50 hours a week?
I live in IL and my schedule just changed to 50 hours a week, so I'm not sure if this is fair. Plus because of the Labor Day Weekend I only worked for 45 hours, and I didn't really take a lunch break, so is it legal that I'm being charged for these lunch breaks and now I'm only left with 40 hours on my check?

When I was working for a company in IL, we were required to punch out for 30 minutes for lunch if we worked more than 6 hours that day. I don't know what you mean by 'I really didn't take a lunch". But you are required to take a lunch break, and they do not have to pay you for it.

If you actually took the lunch break, then yes it is legal.

If your lunch break was interrupted, they may have to pay you for it.

Go in early one day and read the posters near your time clock. This should explain things for you. If you think that your employer is violating your rights, call the IL Dept. of Labor. Their number is on one of those posters.

First of all 50 hours a week is not part time. In fact if you are working hourly they owe you 10 hours a week overtime. Yes to answer your question they can deduct for lunch. If you are supposed to take 1/2 hour and you don't then you are giving them your time. They are assuming that you are taking a lunch break. Hourly employees are only paid for the actual hours that they work.

labor laws require workers to have at least a 30 minute lunch break for an 8+ hr day and the employer does not have to pay you for that time - hardly anyone gets paid for lunch-nothing illegal about what they are doing

Your employer is not required to pay you for your lunch break. They are required, though, to see that you take it if they aren't paying you for it. Most places don't pay for lunch breaks.

There is no law against scheduling a "part time" person for 50 hours in a week. They are required by law to pay you overtime though for hours over 40 that you actually work. Any vacation, sick days or other paid time off doesn't count toward the 40 hours.

if you didnt take them then they cant deduct pay from u. but if its fishy call the labor board and ask them and explain it to them. and if it is illegal report them

If you're working 40 or more hours per week, you are not "part time."

If you pay for it I would take it - tell them to pound sand while you're on break or pay you for it via overtime (always on any part-timer form).
