Can an employer withdraw taxes and not pay them?
I had two different employers in 2007. Just received my Social Security statement. My salary for one employer is listed. My salary for the other (former) employer is not listed.

I checked my W2 and my pay stub. Taxes for social security, medicare, fica, etc were withheld. So what happened? Did my employer not pay the taxes?

They are a very small company. Three employees! My first reaction was they're trying to pull a fast one and get away with it not paying. My second reaction is that no one would ever do that because it's impossible to get away with it. My third reaction is that maybe since they're so small they might be able to get away with it just as long as no on catches on and they do not get audited.

Thoughts? Are they up to no good? Or does it sound like an honest mistake? Is there away to verify if my federal and state taxes were actually paid?

Who should I call? My lawyer? My accountant? My previous employer? Social Security?

First, you have to file your return for it to show up on the statement. If there's no record from the other employer, they may have not filed the W2 or maybe didn't pay the tax - either way, it's a problem for them. Contact your accountant.

A small employer's paper report takes longer than this to get into the Social Security computer. Of course you should save your W-2 to be sure, but it's nowhere near time to panic. If those 2007 wages don't show up on next year's Social Security statement, that will be time enough to report the discrepancy to the Social Security Administration.

3 employees. Your employer sent in paper W-2s, not electronic ones. It can take AGES for the paper forms to get entered into the computer.

In the mean time SAVE your copies of both the W-2 and the paystubs. You will use those to prove to the IRS that you were paid and also to the SSA when you retire to get the earnings history updated.

Since this was for 2007 wages it's entirely possible that those wages have not fully posted to your SS earnings record yet. Employers have to give you your copy of Form W-2 by the end of January, but they don't have to file the government copies with SSA for another month or so. It takes the SSA most of the summer to post all of the earnings to everyone's earnings records. Since your statement comes fairly early in the year it's entirely possible that it won't fully reflect 2007 earnings for a few more months.

While you can contact the SSA on this, it would make more sense to wait until next year's statement and see if it's posted then. If it's not posted on next year's statement, THEN contact the SSA about the discrepancy. If you call them now, they will just tell you that 2007 postings are not yet complete and to verify it NEXT year.

Since you got a W-2 and presumably filed a tax return including those wages you can safely assume that they reported the wages. If they didn't, both the SSA and IRS will be contacting them in the near future about the discrepancy. While it is possible that they didn't report the wages, it's HIGHLY unlikely. It's much more likely that they either filed the government copies late, or that the SSA just hasn't posted it to your earnings record yet.

Your employer was not required to send the W2's to the SSA until February 29. And as already mentioned, with a small employer they would have mailed them in on paper.

I would not expect that at this point in time that those wages would show on a report you just received.

CONTACT THE SOCIAL SECURITY OFFICE RIGHT AWAY AND THE DEPARTMENT OF EMPLOYMENT. This will be reflected when you go to apply for unemployment or when you go to retire.

All employers have to report wages and withholding right away. They can not deduct something from your check and not report them to the right away.

If you do the crime, you will pay the time in prison.

They CAN do that. Mind you, it's illegal, but they CAN. And they will get what is coming to them in the end, eventually, and they will wind up in jail.

It is possible to not report - but they will go to jail for fraud.
Call Social Security and have the W2. W2 details are supposed to be reported to the government for the entire company of the year by Jan. 31st. They sould be able to help.
