 Payperiod is 10/1-15. Employee is paid, however resigns on 15th, not entitled to pay for the 15th.?

Can an former employer with a stick up his butt refuse to send a former employee their W 2's?
I had a falling out with an employer in early 2007 i just got sick of the place... I did no damage or stole anything.(i told em off... i will admit that). I was only about 6 months (but it was like years in hell.).anyway... I moved since I worked there and I called and gave him my new address on his general voice mail over a month ago but they haven't sent my W2's ..Do I have any recourse..I need to get going my taxes and getting that refund!

The W-2's aren't even due to you yet - they have until Jan 31 to mail them.

If you don't have it by Feb 15, call the IRS and ask them for help getting it.

It's way too early to start worrying. He has until January 31st to get them in the mail to you. If you don't have it by February 15th you can then call the IRS and file a missing W-2 complaint. Usually it only takes one call to the IRS to get a recalcitrant employer off his butt and get the W-2 out to you.

Don't waste your time calling the BBB. They can't help you. No idea where she pulled that one from; now I think I've heard it all.

An employer with a stick up his butt is exempt from normal filing requirements.

You can call the IRS 1-800-829-1040. Tell them what happened and they will send your former employer a letter saying they must provide you a w-2. If you don't get it, find ur last paystub. If you call the IRS they will expect to not have one w-2 and you won't get audited. This happened when I worked at a strip club a few years back. I just used my best guess on what I earned.

We had this problem with on of my husbands past employers. We called the IRS and you have to attempt to make contact with the past employer and ask them to send you your W-2. By law they have to send it to you no later Jan.31, 2008 for last year. If they still refuse you can call the IRS and ask them to send you a printout of what was reported to them and they will sent it to you if you inform them that you have contacted the employer and they refuse to send it you. But you have to contact the employer first, give them their alloted time to send it to you, and after that contact the IRS. Our printout showed the amount of money and the employer on the form we recieved, so if the employer doesn't send it to you the IRS will send you accurate info to do your taxes, trust me, they want their money!

Legally, they only have to mail it to your last known address. My suggestion would be for you to look for your last pay stub from the company and use it to do your taxes. The other option would be to go into their office and ask (beg if necessary) for a replacement W-2. They are not required by law to give you more than one copy, so you probably should be ready to be REALLY nice.

call your better business bureau, maybe they can help point you in the right direction...have you tried going in for it? I dont think legally they HAVE to mail it....
