The IRS created a nine-digit Individual Tax Identification Number in 1996 for foreigners who don't have Social Security numbers but need to file taxes in the U.S. But it is used whether you are a legal or an illegal alien.
The IRS doesn't deal with illegal alien status, the Immigration and Customs Enforcement office does that.
You need to apply for a Individual Taxpayer Identification Number (otherwise known as the ITIN). To obtain one, a person needs to submit to the IRS an application and a document that serves as proof of identity, such as a visa or driver's license.
The agency has no way to track how many were immigrants, but it's widely believed most people using ITINS are in the United States illegally. |

An illegal alien should not be eligible for a social security number and would not file with it for that reason.
Some LEGAL aliens do qualify for a social security number and they do file taxes using that number.
If an alien who does qualify for a social security number has income subject to tax then they file taxes using an ITIN. The ITIN is a tax ID number for an individual who does qualify for a social security number. You apply for an ITIN on IRS Form W-7.
Please note that not everyone filing a W-7 is an illegal alien. You may have US based income even if you are not residing here or may have interest in a business here or something else. There are a multitude of legitimate reasons for needing and ITIN and properly paying your taxes. |
