i owe council tax and am writing letters to council offering monthly payments, with cheques they have ignored me but cashed my cheque, bailiffs could still come round.
im worried they'll take our car?
how can they just turn up and take a car?
realistically what would they do if they came round?

Why do you think the bailiffs are coming round anyway? You didn't pay your council tax bill and eventually you received a summons. The summons went to court with or without you attending and a liability Order was granted in their favour.
The next thing they will do is send you a 14 Day Letter. This states that a Liability Order was granted and you have 14 days to either pay the debt in full or contact them and make a repayment arrangement.
Stop writing to them and guessing. Call them and wait until you get to speak to someone who can tell you what stage your account is at. If it has already been passed to bailiffs, any payments you make to the council will be considered a "direct" and the only action taken will be for the council to inform the bailiffs that your debt has reduced by the amount you paid so they are collecting the correct amount.
If the account is still with the council, you can try to make a repayment arrangement. They will have asked you for your work or benefit details on one of their letters. You must provide these, this is their way or securing payment. If you do not respond, they will send the case to the bailiffs as they have no alternative way to collect your debt.
The bailiffs will not come and collect your car without speakign to you, they will call at the house and firstly try to make a repayment arrangement with you. DO NOT let it get to this stage if your debt is still with the council, the bailiffs fees can be large.

they can put it on the back of a recovery truck and take it if you don't co-operate. i would think they'd give notice if they are going to take your car. i'd give the council and the bailiff company a call to see exactly where you stand. hopefully if you are paying the council it'll be ok. good luck x x x |

Keep a copy of all letters and bank statements with the cheques on to show the baliffs. Dont write directly - wait until they come round. I dont think they will come as the council have obviously had your letters, they are just not bothering to reply, the fact they have taken your money is enough of a receipt for the baliffs.
They could take the car if they wanted - they have the powers to do anything. If they cant take the car due to lack of keys, they just clamp it until you give in, but I think you are safe as long as you keep to your agreement and send cheques until you are out of debt. |
