Can any product be sold higher than MRP in any particalur place/area?

In view of the court judgement on the subject, a product can be sold higher than its MRP in a restaurant or a hotel or a resort because of the comfort/luxury, ambiance, service or any other feature besides the basic product is also offered/served.

one should sell the product less then to mrp but he cant sell it more then the mrp

No, but the shop-keepers make use of a catch that local taxes will be extra.

Sometimes they charge extra for additional services carried out like keeping the soft-drink cool.

In fact, one can even bargain for a discount on the MRP since it is levied on an all India basis and it might be much cheaper at your place of sale.

Mostly, since the amount involved is not very high and people are generally in a hurry they do not want to get into a fruitless argument with the shopkeeper.

Also, still if one persists, the shopkeeper will never proffer a Valid receipt which will stand up in a court of law giving various excuses and holding you up further.

Regarding the 2nd part of your question, you can raise it with the higher authorities provided you retain the Original Receipt and if successful can lead to his license being cancelled / suspended.

You can report it to the consumer forum.

I have also seen some things like mineral water bottles or cold drinks being sold at a much higher price than the MRP. But, we cannot complaint against them because they add the extra cost saying it is "service charge" which means the cost which you pay because you are enjoying the AC of the restaurant, etc. So, reporting it may be a waste of time.

hey i'm a guy from banglore. here in the milk covers the mrp is 7 for ordinnary & 10 for special milk. but the shopkeepers sel it for 7.50& 10.50 respectively. not only here almost everywhere this is the rate......

if you are selling your own product ,if it is not an essential commodity , you can fix any MRP. A single tea is sold for Rs. 3 in platform and rs 30 in star hotels.there is a price controll for essential commodities only. for the other if you pay proper taxes for the MRP you sold, there will be no legal problem. but will people buy it for higher MRP, it is your part to explain your customers and middlemen, about what is the unique speciality in your product.

NEW DELHI. Vide a significant ruling AIT-2007-102-HC the High Court has ruled that charging prices for mineral water in excess of MRP printed on the packaging, during the service of customers in hotels and restaurants does not violate any of the provisions of the Act as this does not constitute a sale or transfer of these commodities by the hotelier or Restaurateur to its customers. The customer does not enter a hotel or a restaurant to make a simple purchase of these commodities. It may well be that a client would order nothing beyond a bottle of water or a beverage, but his direct purpose in doing so would clearly travel to enjoying the ambience available therein and incidentally to the ordering of any article for consumption. Can there by any justifiable reason for the Court or Commission to interdict the sale of bottled mineral water other than at a certain price, and ignore the relatively exorbitant charge for a cup of tea or coffee.
The question that arose in the Bunch of Petitions was whether it is impermissible for the Petitioners to charge their customers/guests the any price above the maximum retail price (MRP) mentioned on mineral-water packaged and bottled by third parties

mrp stand for maximum retail price. it means there will be minimum retail price. but most of the times the seller will sell the product for mrp only for the reason that the consumer never ask for the minimum price than mrp. in tourist places they will sell the good according to the demand since tourist will come once in a blue moon. it is our responsibility to ask for a price less than mrp.
