Kumatsutaku Jr. | Can california prop 8 take away tax exempt status for churches? |
Me and my brother have been arguing over this with him saying because churches don't accept gay people, they get their tax exempt status taken away. |

All it does is define marriage in the state constitution as the union of a man and a woman. |

Nothing in the bill would take away Churches tax exemption status. It's just fear mongering. Most of what the Yes on 8 people are putting out are lies. They know they can scare people into voting with them. |

The Catholic church down the road will not perform a wedding currently for me (male) and my wife (both agnostic/deist/non-Christians). Nor will they let us perform our own wedding in their chapel. Nor do they have to recognize our wedding (except in cases where they receive tax money). They currently are tax-exempt. They will be regardless of Prop 8. |

No, if prop 8 does not pass, churches will not have their tax exempt status taken away for refusing to marry a same-sex couple. Churches may choose whom they marry; the Catholic church, for instance, does not marry non-Catholic couples. They have received no repercussions for such refusals.
The assertions that gay marriage will cause churches to lose their tax exempt status, will be taught in schools, and that people will be forced to "accept it" are all propaganda put out by the supporters of the proposition.
If proposition 8 passes, the following would be an amendment to the constitution:
"SEC. 7.5. Only marriage between a man and a woman is valid or recognized in California."
A very small, simple amendment that would cause monumental changes and legalize blatant discrimination against gays and lesbians.
Proponents of the initiative would have voters believe that rights would not be stripped from same-sex couples, but that is a lie. There are FEDERAL rights granted to married couples that are not given to couples who enter STATE "civil unions." If prop 8 passes, same-sex couples will not granted the same legal benefits as a traditionally married couple. Couples who are already married would also lose their rights as a married couple because California would no longer recognize their union as legal. That would dissolve more than 11,000 legal marriages!
Proposition 8 does all harm and no good. Just say no. |

I found the source of the "Yes on 8" peoples claim that a church could lose their tax exempt status for refusing to marry a same sex couple. An Ocean Grove, New Jersey Methodist church refused to allow non-member lesbians from using their grounds for a commitment ceremony. It turns out the tax exemption was not the IRS 501(c)3, but rather a local tax break given by NJ to organizations that open their property up to the general public. This church took the tax break, then decided lesbians aren't part of the general public. This wasn't even in CA or MA, it was in NJ, which doesn't recognize same sex marriages. Prop 8 would have no effect on such a local tax matter in CA or any other state. |

The only thing I heard related to this was on NPR the other day, where an "expert" (i don't know his credentials) said that Churches cannot get sued if they don't perform marriages for homosexuals. They didn't mention tax exemption though. |

Tax exempt status has nothing to do with whether or not churches or any other religious non-profit accept gay (same sex) marriage. In order to change that they would have to change how they organize in CA as an entity.
Proposition 8 is all about changing the California Constitution to define the word Marriage by inserting language defining Marriage as between a man and a woman. It's a return to California's Prop 22 that was passed in 2000 by voters and then thrown out by the Ca. Supreme court as being un-constitutional.
Anyhow, here is some ammo for your argument.
First, the entire text of the proposal as it reads on the Nov. 4th Ballot.
This initiative measure is submitted to the people in accordance with the provisions of Article II, Section 8, of the California Constitution.
This initiative measure expressly amends the California Constitution by
adding a section thereto; therefore, new provisions proposed to be added are printed in italic type to indicate that they are new.
SECTION 1. Title
This measure shall be known and may be cited as the “California Marriage Protection Act.”
SECTION 2. Section 7.5 is added to Article I of the California Constitution, to read:
SEC. 7.5. Only marriage between a man and a woman is valid or recognized in California.
Second an opinion article by Bacon.

No, not yet!!!!....Where do we stop people, if it's okay for a man to marry a man and a women to marry a women, why not I love my pet dog and want to make a commitment to him for life or better yet.....This teenage girl or boy (i.e. nambla). We better think about the future people....God put us here to reproduce and glorify Him. With this stuff going on the future looks dim.
Yes on Prop 8 |

A YES vote on Proposition 8 means that you want to eliminate the rights of two consenting adults to marry each other. A NO vote means you want keep California law the way it is now; any two consenting adults regardless of gender can have a marriage which is recognized by the State.
The non-passage of Proposition 8 will not affect churches at all. Voting NO will NOT make any church perform any wedding it doesn't want to.
Same-sex marriage is currently legal in California. Have you or your brother heard of ANY church ANY where in the State at ANY time being sued (or having its tax-exempt status challenged) for not wanting to perform a wedding for a gay couple? Surely, if it had happened, the Yes on 8 Campaign would have jumped all over it.
Proposition 8 should be defeated. |

No that is a lie created by the so-called "moral" people who support prop 8. Churches do not have to marry anyone they do not want to and they do not have to accept anyone they do not want to. Churches are legally allowed to discriminate against anyone for any reason and always will be allowed to. Prop 8 is simply about churches trying to use their right to discriminate outside the doors of the church. We have separation of church and state in this country for a reason and it's time for voters to recognize and support that separation. |
