Open a LLC and file for S corp tax filing, then make sure you show no profit.

yea sure but when the IRS catches up with you b prepared to pay big time and plan on wearing orange

You asked - I answered
No. Once the government catches up to you - you'll owe them the taxes plus they bag you for all the interest too. I would strongly advise you not to attempt that.

A sole proprietor has to pay income tax and approx 15% social security tax (Self Employment tax) on their profit. If you have no profit, you pay no tax. If you have profit, you must pay this tax.

The only legal way to reduce the social security tax is to form an S Corporation (it could also be a LLC set up as an S corp). As the owner, you might expect to pay yourself about half of your profit in wages, which are subject to social security tax. The other half of you profit would flow to your personal 1040 on line 17. This would be subject to income tax, but would avoid social security tax. At this point the IRS has not questioned this tactic, but it could be subject to change if the IRS decided to crack down on it.

Please also note that by paying little or nothing into social security, you will get little or nothing back. As always, consult with a tax professional for specific answers. CPA Greg - glindatax.com

all the other answers you received are correct. If you are on a cash basis and can accelerate your expenses to the current tax year, you can reduce the amount of your income, thus your self employment taxes.

But, here is another concept for you. If you are married and your spouse is on payroll, have your spouse as a 50-50 partner in your business. Since their is a ceiling with the amount of self-employment (aka social security taxes) you pay, the social security on the outside payroll would go to reduce the amount of self employment taxes that would be paid. Same would apply to you if you were employed elsewhere.

Yes, until the IRS finds out that you haven't paid.

unless your clients are all private citizens and use cash (and you are in a business where you would not be a tax deduction), you may be able to slide under the radar. However, once you contract yourself out to a person who will be using your pay as a business or other deduction, you lose that chance, since they will report what they paid to you to the IRS (with your name on a 1099 since the IRS will want proof).
