Jss is correct. 5*0*4 and Deborah F are very close - some local areas, as well as some states, have laws against cohabitation by unmarried adults that would mean you couldn't claim her, even though the laws aren't enforced any more.
I continue to be amazed at the number of wrong answers this type of question draws. |

she's a u.s. citizen
you can claim her as a qualifying relative but not as a dependent if all the above applies.

She lived with you all the year
You provided more than half of her support
She did not earn more than $3,500
Your relationship does not violate local laws.

You can claim her if your situation meets ALL of these requirements:
1) Her parents are not claiming her as a qualified child. (If she's 19 and a student they might be.)
2) She must have lived with you for the whole year.
3) Her income must be less than $3,500
4) You must have provided more than 1/2 of her support
If you meet all these requirements, then you can claim her as a dependent. You can also take education credits for the amounts she pays for tuition and fees (not books or supplies). She does not qualify you to be head of household. |

Most states do not accept common law marriages. Check out the practices in your area based on the link below. I would caution you in doing so. She may be eligible for half your household goods, etc., just as a wife would AND now she would have legal proof that you considered her your common law wife.
