Bostonia is correct. Everyone else has blown it. If he lived with you ALL year, you provided more than half of his support, he had less than $3,500 in gross income except for Social Security, and your relationship isn't illegal under local law then you CAN claim him as a Qualifying Relative.
You can only claim the exemption though. No Head of Household, EIC, Child Tax Credit, etc. based upon him. |

Hmmm. Another batch of bad answers. Here's the CORRECT answer!
You can claim an unrelated person as your dependent under the Qualifying Relative rule (yes, I know, it sounds wrong but it isn't) if ALL of the following conditions are met:
1. He or She is a US citizen or resident.
2. He or She did not file a joint return with another taxpayer.
3. He or She is not the Qualifying Child of another taxpayer.
4. He or She lived in your home ALL year.
5. You provided more than 50% of his or her entire support for the entire year.
6. He or She had less than the personal exemption amount ($3,500 for 2008) in gross income, excluding non-taxable Social Security benefits.
7. Your relationship is not illegal under local law, even if such law is unenforced. These are the states where it violates local law: Florida, Michigan, Mississippi, North Carolina, North Dakota, Virginia, and West Virginia. There are local ordinances against cohabitation in many other states though, so check your local laws first.

Here are a few rules that he would have to meet before you could claim him:
a) He can't be the Qualifying Child of another taxpayer or claimed on someone else's tax return.
b) He of course must be a US citizen or resident.
c) You would have to have provided more than 50% of his support for the entire year.
d) He had to have earned less than the personal exemption amount of $3,500 for 2008, excluding non-taxable Social Security benefits.
e) Your relationship of cohabitation must be legal in your state
If your boyfriend meets all of those requirements, you would be able to claim him under what is known as the Qualifying Relative Rule. Now although you might be able to claim him if he meets all of the above criteria, this excludes him from allowing you to use him to qualify you to receive things like the earned income credit.
