You can claim an unrelated person under the Qualifying Relative rule if all of the following tests are met:

1. He's not he Qualifying Child of another taxpayer.
2. He lived in your home ALL year.
3. He had less than $3,500 in gross income in 2008, excluding only non-taxable Social Security. (Unless he worked part-time for VERY low wages, he probably made too much.)
4. You provided more than half of his support for the ENTIRE year.
5. Your relationship is not illegal under local law. These are the states where it violates local law: Florida, Michigan, Mississippi, North Carolina, North Dakota, Virginia, and West Virginia. Some local jurisdictions also prohibit unmarried persons of the opposite sex from cohabitating so check your local laws. Even if the law is not enforced, it bars the exemption claim.

You can claim him if he lived with you ALL year, had income under $3500, you provided over half of his support, AND your relationship isn't illegal under state or local law - there are still a number of states, and some local areas, that have laws against cohabitation by unmarried adults - if the law is still on the books where you live, even if it isn't enforced any more, you can't claim him.

If he worked part of the year, or collected unemployment, and his total income from those was over $3500, then you don't pass the gross income test so you can't claim him.

If he worked for 6 months, chances are excellent that he made at least $3,500 in wages (or self-employment net income). If this is true, then even if you paid the bills, you cannot claim him as a dependent.

He will have to

1. Live with you all year
2. Have income subject to tax of less than $3,500
3. Be support more than 50% by you

in order to be your dependent.

i highly doubt it. you either need to be legal partners, married, or have a common-law marriage. somehow the government must be aware of your relationship, formally.

If he does not make more than $3400
If you provide over 50 percent support.
If he lived with you over 6 months.

Claim him?? As what? wish you had been more specific. You can't file joint he is not your spouse. He is not your minor child & isn't a dependent. This doesn't qualify as head-of-household.
